It shall be unlawful for any person to hawk or peddle any farm, garden or dairy products or fruit, excepting of his own raising, or any goods, wares or merchandise within the limits of the Borough of Baden without having a license from the Mayor so to do. Said license shall be issued only for the hours from 10:00 a.m. to 5:00 p.m. of each day of the license period. No peddling, hawking or soliciting shall be permitted during any other hours.
The license shall be issued by the Mayor upon and with the following conditions and restrictions, and it shall not be issued otherwise.
A. 
The said Mayor shall be satisfied that the applicant is of good moral character and that he is not afflicted with and has not been exposed to any infectious or contagious disease.
B. 
The said applicant will remain of good moral character; that he will be honest in his dealings with the people of Baden, and that he will use standard weights and measures adopted by the Commonwealth of Pennsylvania.
C. 
The said applicant will not sell or offer for sale anything that is adulterated, impure or unwholesome or that is infected with disease.
D. 
The said applicant will keep and comply with all the ordinances of the Borough of Baden.
The said applicant shall pay to the Mayor for the use of the Borough of Baden, at and before the issuing of said license, the following fees:
A. 
For hawking goods, wares or merchandise by gathering people together on the streets, per day: $10.
B. 
For peddling from door to door with a truck, automobile, team or one-horse conveyance, excepting regular hucksters and dairymen, per day: $5.
C. 
For peddling from door to door on foot, per day: $2.
D. 
Hucksters selling produce other than of their own raising, from door to door with truck, automobile, team or one-horse conveyance, per year: $5.
E. 
Dairymen selling dairy products other than their own, by truck, automobile, team or one-horse conveyance, per year: $2.50.
Any and all licenses may be revoked if, in the opinion of the Mayor, the applicant is or has become unfit or has violated any of the requirements which are set out in § 108-2 hereinabove.
Any person who shall violate any provision of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $300 and costs of such proceedings or, upon default of payment of such fine and costs, by imprisonment in the county jail for a term of not more than 30 days.
