On and after approval of this chapter, it shall be unlawful for any person, persons, corporations or association to erect or maintain any poles for conducting electricity for telephone, telegraph, electric light, heat or power or electric street railway purposes or other public utility wires or necessary devices incidental thereto or connecting therewith on any public road, street, alley, lane or highway within the Borough of Baden or to support any wires or cables thereon or to construct any such wires on any poles so as to overhang or project over any road, street, lane, alley or highway within the said Borough without first having filed with the Borough Secretary a map or plan showing the exact location of each pole or attachment thereto in relation to the boundary and central lines of the road, street, lane, alley or highway along which it is to be erected.
Every pole erected as aforesaid shall be plainly marked with the name or identification mark of the person, persons, corporation or association owning the same together with a distinctive or identifying number which shall be noted on the map or plan herein required to be filed with the Borough Secretary.
Editor's Note: Former Sections 3 and 4 of Ord. No. 275, adopted 12-6-1943, which dealt with inspection of poles and defraying of costs, which immediately followed this section, were deleted 5-15-1985 by Ord. No. 759.
Any such person, persons, corporations or association erecting or maintaining poles, attachments, wires or cables upon or over the roads, streets, lanes, alleys or highways within the limits of the Borough shall be responsible for any and all accidents and damages resulting from his, their or its negligence either during the erection or the subsequent maintenance of such poles, attachments, wires or cables and shall at all times indemnify and save the Borough harmless from any suit, claim or damage that might arise from the erection or maintenance of any such poles, attachments, wires or cables.

Any person who shall violate any provision of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $300 and costs of such proceedings or, upon default of payment of such fine and costs, by imprisonment in the county jail for a term of not more than 30 days.
