The owners of abutting property on all streets within the Borough of Baden shall furnish all materials and curbs and pave the sidewalks in front of their respective properties, whenever requested by the said Council to do so, at their own proper cost and expense, in accordance with this article.
Concrete cement pavement shall be the only kind to be laid on any of the sidewalks within said Borough and shall not be less than five feet in width.
The pavements shall be laid in relation to the curb and property line as follows: on all sidewalks 10 feet and over in width, the outside edge of the pavement shall be placed 3 1/2 feet from the outside edge of the curb. On all sidewalks more than 7 1/2 feet and less than 10 feet in width, the outside edge of the pavement shall be placed 2 1/2 feet from the outside edge of the curb. On all sidewalks 7 1/2 feet and less in width, the inside edge of the pavement shall be placed at the property line.
The slope on all pavements from the curb toward the property line shall be as follows:
A. 
On pavements six feet and over in width, the pavement shall begin at the curb grade and thence by an ascending grade of three inches to the property line.
B. 
Pavements less than six feet in width shall have a slope of 1/2 inch to the foot from the curb to the property line. Stakes showing the established grade will be set by the Borough Engineer whenever requested.
The excavation for the pavement shall be of sufficient depth and width to provide for the following: Each layer of the pavement shall be of the same width as the top of the pavement; a foundation of eight inches of broken stone, none of which shall be over three inches in diameter, or eight inches of well-tamped cinders, clean and hard and clinkers excluded or finely broken. On top of broken stone or cinders shall be a concrete base of three inches, on top of which shall be a top coat of one inch.
The concrete base shall be not less than three inches in depth and made of one part portland cement and two parts clean sharp coarse sand and four parts gravel, the largest stone of which shall pass through a one-and-one-half-inch ring. The sand, gravel and cement shall be thoroughly mixed dry and then made to a proper consistency with water, and then spread over the cinders, and well and evenly compacted by tamping to a height not more than within one inch of the surface to receive the wearing surface. The wearing or top surface shall not be less than one inch in thickness and shall consist of one part portland cement and two parts coarse, screened, sharp sand; the sand and cement to be thoroughly mixed dry, and just sufficient water shall be added that, when well-tampered into mortar and well-tamped down, the base water will rise to the surface, after which it shall be stroked with a straight edge and floated and troweled to a true, finished surface exactly to grade and slope; the pavement is to be put in between guide strips, securely fastened to grade and line, and laid in sections four to five feet long with a square, vertical sand joint 1/2 inch in width extending through the depth of the concrete; the joint to be made by a strip of wood or equivalent. On steep grade, the pavement shall be floated to a rough-grained surface. Only such brands of portland cement shall be used as shall be approved by the Borough Engineer or Street Commissioner.
A. 
At the lower corner of each property and at intervals of not more than 100 feet, the said bed of broken stone or cinders shall be drained to the curb by digging a ditch 12 inches wide of the same depth as excavation for foundation, the same to be filled with eight inches of broken stone and leveled to the surface.
B. 
All the above-mentioned side drains other than those to be placed at the lower corner of each property shall be put in where directed by the Borough Engineer or Street Commissioner. Whenever it shall be thought necessary by the Borough Engineer or Town Council by reason of running or standing water, or for any other reason necessitating it being done, the eight inches of broken stone shall be underlaid with a drain of broken stone, said drain to be eight inches in depth and to be located where and made of such depth and width, length and shape as to properly receive and dispose of all surplus water.
All work shall be done under the direction of and to the acceptance of the Street Committee or the Borough Engineer, and any material or work done not meeting with the requirements of the foregoing specifications must be removed and replaced by work and material satisfactory to the Street Committee and the Borough Engineer.
A. 
After the pavement is finished, the property owner shall level and slope the portion of sidewalk not occupied by the pavement, and the surplus dirt, if needed on the streets, shall be taken away by the Borough of Baden, but otherwise shall be disposed of by the property owner. The property owner shall cart away all rubbish and put the street and sidewalk in clean and good order in front of his premises as fast as the pavement is laid. Surplus earth and spawls shall in no case be thrown in the roadway without permission from the Borough Engineer or Street Committee. Should the property owner neglect or refuse to remove the rubbish made and left by him within three days after being notified by the Street Commissioner to have the same removed, the Borough will proceed to dispose of it at the property owner's expense.
B. 
The property owner must keep the gutters cleaned and unobstructed at all times.
Should any owner of property refuse to put down his, her or its pavement, or to complete the same after work has been begun, within 30 days after having been notified by the Town Council so to do, the same shall be done by the Borough at the expense of the lot owner, adding thereto 20% of the actual cost for such failure.

Any person who shall violate any provision of this article shall, upon conviction thereof, be punishable by a fine of not more than $1,000, not less than $300, and the costs of such proceedings or, upon default of payment of such fine and costs, by imprisonment in the county jail for a term of not more than 30 days.
