Every owner of property located in the Borough of Baden, within the County of Beaver, Commonwealth of Pennsylvania, whose property abuts upon any public water system constructed or to be constructed in the Borough of Baden in the future whose principal building is within 250 feet (measured horizontally) of a water main or water lateral intended to service the property shall obtain a water permit from the Borough of Baden, make connection therewith and use such water system in accordance with the rules, regulations, resolutions and ordinances of the Borough of Baden, such connection to be at the sole cost of the owner; however, no property owner shall be required to connect whose property has been finally determined by the Borough Council of the Borough of Baden to be not reasonably accessible to the water system.
It shall be unlawful for any owner, lessee or occupier of any property in Baden Borough, wherein the principal building is required to connect to and use the water system, to employ any means, by well or other alternate system, to provide water other than by way of said public water system.
When any owner, lessee or occupier of a structure required under this article to connect to and use the water system who is now or hereafter may be using any method of supplying water other than through said public water system, Baden Borough shall be empowered to notify the owner, lessee or occupier of such structure in writing, either by personal service, certified mail or registered mail, to discontinue the same and make proper connection for the acceptance of water through the aforesaid public water system as herein provided within 90 days after receipt of such notice.
No private wells or other alternative methods of water supply shall at any time be connected with the aforesaid public water system.
No person, firm or corporation shall make or cause to be made any connection with any of the aforementioned public water system until they have made proper application for and received a permit from the Borough of Baden and has paid any prescribed fees as found in other ordinances, resolutions or rules and regulations.
The construction of all building waterlines or home service water systems shall be made in accordance with the specifications, plans and procedures established by the Borough of Baden as the same may be from time to time published and amended, copies of which shall be placed on file with the Borough of Baden.
If the owner or owners of any principal building or structure in said Borough of Baden which is required to connect to and to use the water system shall neglect or refuse to comply with the provisions of this article on the written notice as prescribed in § 187-31 hereof, the Borough of Baden may perform or cause to be performed such work and labor and furnish or cause to be furnished such material as may be necessary to comply with the provisions of this article at the reasonable costs and expenses of such owner or owners, together with all charges and expenses incidental thereto, which sum shall be collected from said owner or owners for the use of the Borough of Baden as debts are by law collectible, or, if not paid within six months of completion, the Borough of Baden shall file municipal liens as provided by law.
In addition to any penalty hereinabove prescribed, any person, firm or corporation violating any provision of this article shall, upon conviction thereof before a District Magistrate, be fined not less than $50 and not more than $300 and, in addition, shall be required to pay the costs of prosecution and, in default of payment thereof, shall be sentenced to undergo imprisonment for not less than five days and not more than 30 days in the Beaver County Jail. Each day that said violation shall exist shall constitute a separate offense hereunder.
