[HISTORY: Adopted by the Borough Council of the Borough of Kingston 6-6-1994 by Ord. No. 1994-10. (Editor's Note: This ordinance repealed former Ch. 121, Mechanical Standards, adopted 7-9-1990 by Ord. No. 1990-20.) Amendments noted where applicable.]
A certain document, three copies of which are on file in the office of the Municipality of Kingston being marked and designated as the "BOCA National Mechanical Code, Eighth Edition, 1993," as published by Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Mechanical Code of the Municipality of Kingston, Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Mechanical Code are hereby referred to, adopted and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 121-3 of this chapter.
Ordinance No. 1990-20 of the Municipality of Kingston, entitled the "BOCA National Mechanical Code, Seventh Edition, 1990," and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
The following sections are hereby revised as follows:
A. 
Section M-101.1 (page 1, second line), insert: "Municipality of Kingston."
B. 
Section M-113.2 (page 4, third line), delete paragraph.
C. 
Section M-113.3 (page 4, third line), insert "Where the total valuation of the mechanical work is in the following ranges, the corresponding fee is as follows:

"For each $1,000 or portion thereof of work involved over and above the sum of $10,000, an additional fee of $5 per $1,000 shall be charged. Permit fees will be doubled for work started prior to application for permits."
D. 
Section M-116.4 (page 5, seventh, eighth and ninth lines), insert: $300; 30 days.
E. 
Section M-117.2 (page 5, fifth and sixth lines), insert $30; "$300."
Nothing in this chapter or in the Mechanical Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 121-2 of this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
