The municipality of Kingston does hereby establish a child-safe zone
which means an area within 200 feet of:
A.
The perimeter of the real property comprising a public
or private elementary or secondary school;
B.
The perimeter of the real property comprising a child-care
center, child-care facility or day-care facility, a nursery school or preschool;
and
C.
The perimeter of an athletic field, park, playground
or recreational facility or other place wherein children typically gather
whether it be privately or publicly owned.
A.
A person is guilty of violating a child-safe zone if
the person has been previously convicted of a crime requiring registration
under 42 Pa.C.S.A. 9795.1 or previously convicted in another jurisdiction
for conduct substantially similar to that contained in 42 Pa.C.S.A. 9795.1
and that person enters, resides, works in, loiters at or remains in a child-safe
zone.
B.
A person described in the previous subsection may enter
a child-safe zone only:
(1)
For activities involving that person's own child
and only with advance notice and approval from those in charge of the location;
(2)
If the person is working or residing within the child-safe
zone on the effective date of this article, if the person's place of
employment is within a child-safe zone because a school is relocated or if
the person only intermittently or sporadically enters a child-safe zone.
(3)
If the person is in or going to or from: a probation
office; premises at which the person is participating in a program, activity
or treatment required as a condition of probation or release; a community
residential facility in which the person is required to reside as a condition
of probation or release; a private residence in which the person is required
to reside as a condition of probation or release or a residence where the
person was residing on the effective date of this section; a hospital or other
medical care or mental health facility where the person is a patient.
(4)
The person is exercising his or her constitutional right
to vote.
Any person who shall violate any provision of this article shall come
upon conviction whereof, be punishable by a fine of not more than $500 and
costs of such proceeding or imprisonment in a county jail for not more than
90 days.
