A. 
Words and phrases, when used in this article, shall have the meanings ascribed to them in the Vehicle Code of Pennsylvania, as now in force or as hereafter amended, enacted or reenacted,[1] except in those instances where the context clearly indicates a different meaning.

B. 
In this article, the singular shall include the plural, the plural shall include the singular and the masculine shall include the feminine.
All traffic and parking regulations of a permanent nature shall be enacted as ordinances or as parts of ordinances or as amendments to ordinances of the Borough of Kingston.
A. 
The Mayor shall have the following powers to regulate traffic and parking temporarily and in time of emergency:
(1) 
In the case of fire, flood, storm or other emergency, to establish temporary traffic and/or parking regulations.
(2) 
In the case of emergency or to facilitate public works or in the conduct of parades, processions or public events, to restrict or prohibit traffic and/or parking in limited areas for periods of not more than 24 hours.
B. 
Such temporary and emergency regulations shall be enforced by the Mayor and the Police Department in the same manner as permanent regulations. Any person who shall operate a vehicle or tractor in violation of any such regulation or who shall move, remove, destroy, injure or deface any sign or marking erected, posted or made to give notice of any such regulation shall, upon conviction thereof, be liable to the penalty set forth in the law or elsewhere in this article for a violation of such nature and, in case of a violation for which no specific penalty is set forth in the law or elsewhere in this article, to a fine of not more than $10 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days.

A. 
The Mayor, with approval of the Council and upon notice to the Council, may, from time to time, designate places upon and along the highways in the borough where, for a period of not more than 90 days, specific traffic and/or parking regulations, prohibitions and restrictions shall be in force and effect, and shall designate such locations by proper signs and markings. Such regulations, prohibitions and restrictions shall be effective just as if they had been specified in this article.
B. 
No person shall operate or park a vehicle or tractor in violation of any such regulation, prohibition or restriction, and no person shall move, remove, destroy or deface any sign or marking erected, posted or made by authority of this section.
C. 
Any person who shall violate any provision of this section shall, upon conviction thereof, be liable to the penalty set forth in the law or elsewhere in this article for a violation of such nature and, in case of a violation for which no specific penalty is set forth in the law or elsewhere in this article, to a fine of not more than $10 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days.
D. 
The purpose of this section is to allow for the test and experimental determination of the feasibility and desirability of permanent changes in the ordinances of the borough relative to traffic and parking.
The peace officers of the borough are hereby given authority to direct traffic on the highways of the borough and at intersections thereof.
A. 
No person shall operate a motor vehicle or tractor upon any sidewalk in the borough; nor shall any person operate a motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose.
B. 
Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $50 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days.

A. 
It shall be unlawful for any person to operate a vehicle or tractor at a speed in excess of more than than 25 miles per hour on any street or alley in the Borough of Kingston, except where a lower speed limit is fixed by law.
B. 
Notwithstanding the foregoing, it shall be unlawful for any person to operate a vehicle or tractor at a speed in excess of 35 miles per hour on that portion of the connecting roadways of Church Street and Third Avenue between Pierce Street and Rutter Avenue in the Municipality of Kingston.

C. 
Any person who shall operate a vehicle or tractor at a speed in excess of that hereby established therefor, upon any street, alley or highway or portion thereof, specified in this section shall, upon conviction thereof, be sentenced to pay a fine of $35 and costs of prosecution and, in the event that the speed limit shall be exceeded by more than five miles per hour, to an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit, or to undergo imprisonment as now or hereafter authorized by law.

B. 
Any person who shall operate a motor vehicle or tractor upon any highway or portion thereof hereby established as a one-way highway, other than in the direction hereby established for traffic thereon, shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days.
A. 
It shall be unlawful for the operator of any vehicle or tractor to make a U-turn anywhere upon any highway in the borough.
B. 
Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days.

A. 
The following intersections and such other intersections located within the municipality as may from time to time be designated by ordinance are hereby established as stop intersections, and official stop signs shall be erected (or are hereby confirmed if heretofore enacted) in such a position as to face traffic approaching the second-named highway upon the first-named highway in the direction or directions hereby indicated. All vehicles and tractors approaching any such intersections upon the first-named highway in the direction or directions hereby indicated in each case shall come to a full stop within a reasonable distance before entering any such intersection.

B. 
Any operator of a vehicle or a tractor who shall fail to come to a full stop within a reasonable distance before entering any stop intersection, as hereinabove required, shall, upon conviction thereof, be sentenced to pay a fine of $25 and costs of prosecution or to undergo imprisonment as now or hereafter authorized by law.
A. 
Vehicles and tractors.
(1) 
It shall be unlawful for any person to operate any vehicle or tractor, except a passenger vehicle or taxicab (but not including any passenger vehicle drawing any trailer or towing any other vehicle), upon any of the following portions of the highways of the borough:

Nothing herein shall prohibit the operation of any commercial vehicle or tractor upon any highway or portion thereof listed hereinabove where such operation thereon shall be necessary in order to pick up or deliver any goods, wares, merchandise or material from or to any premises located upon such highway or portion thereof.
B. 
Gross weight restrictions.

(a) 
Locations.
[1] 
Any vehicle which travels upon East Bennett Street between Rutter Avenue and Wyoming Avenue or which travels upon Church Street between Wyoming Avenue and Church Street shall not weigh in excess of 11,000 pounds gross weight.
[2] 
Any vehicle which travels upon Rutter Avenue between Market Street and Church Street shall not weigh in excess of 11,000 pounds gross weight.
[3] 
Any vehicle which travels upon Division Street between Wyoming Avenue and Railroad Street shall not weigh in excess of 11,000 pounds gross vehicle weight.

(b) 
Exemptions.
[1] 
School buses, emergency vehicles and vehicles making local deliveries to or pickups from buildings located on either East Bennett Street or Church Street are hereby exempted from the foregoing restriction.
[2] 
School buses, emergency vehicles, vehicles engaged in the construction or repair of streets and vehicles actually engaged in making intermittent deliveries or rendering occasional services to residential property on Division Street are hereby exempted from the foregoing restrictions.

(2) 
Enforcement.
(a) 
The Kingston Municipal Police Department and the Pennsylvania State Police are hereby empowered to enforce the weight restrictions established in Subsection B(1) hereof.
(b) 
The Kingston Department of Public Works, in accordance with standards and regulations of the Pennsylvania Department of Transportation, shall erect and maintain restriction signs as required by Section 4902(e) of the Vehicle Code of the Commonwealth of Pennsylvania.[1]

(3) 
Penalties for violation. Any person operating a motor vehicle in violation of the weight restrictions imposed by Subsection B(1) hereof is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of not less than $25 and not more than $100.
The boundary limits of the Borough of Kingston are hereby established as a zone in which motor vehicles may remain standing without lights, and all highways within such boundary limits are hereby designated as highways where motor vehicles may remain standing without lights.

A. 
For the purpose of this subsection, the following definitions shall apply:
COMMERCIAL PARKING
The parking of vehicles for or related to the conduct of business. This definition does not include vehicles engaged in the delivery of goods and merchandise for a period not longer than 15 minutes. This definition does not include vehicles engaged in repair or services for residential properties within the restricted area.
RESIDENTIAL PARKING
Parking for owners, occupants or visitors related to single-family residences or apartments used for the habitation of people.
B. 
The following streets are designated as "residential parking only" streets:

(1) 
The east side of Mercer Avenue from a point 105 feet from the intersection of West Bennett Street and Mercer Avenue to the intersection of Mercer Avenue and West Walnut Street.
(2) 
The west side of Chestnut Avenue southward from the twenty-five-foot "No Parking" area at the intersection of Chestnut Avenue with Pringle Street for a distance of 160 feet.
C. 
It shall be unlawful for any person to park a commercial vehicle or tractor or to allow the same to remain parked in a "residential parking only" zone. It shall be unlawful for any person who is not an owner, occupant or visitor to a single-family residence or apartment fronting the street or avenue designated for "residential parking only" to park a vehicle in said zone.

D. 
Penalties for violation. Any person who shall violate any provision of this section shall be subject to a penalty as set forth in Municipal Code § 170-29E.

Limitation.
(a) 
A two-hour parking limitation is hereby continued for South Dawes Avenue from the intersection thereof with Market Street to the intersection thereof with Pierce Street, between the hours of 8:00 a.m. and 5:00 p.m., Eastern daylight saving time, excluding any area designated as prohibited parking; and the two-hour parking limitation heretofore established for North Dawes Avenue is rescinded.

(b) 
A one-half-hour parking limitation is hereby established for that portion of East Market Street between Dawes Avenue and North Gates Avenue, Monday through Saturday between the hours of 8:00 a.m. and 8:00 p.m. prevailing time.

A two-hour parking limitation during the hours of 8:00 a.m. to 4:00 p.m. prevailing time is hereby established on the west side of Wyoming Avenue and the east side of Wyoming Avenue from the Municipal boundary at Forty Fort to the Municipal boundary at Edwardsville at all locations not falling within 25 feet of intersections where parking is prohibited and/or not otherwise subject to another more restrictive specific traffic control.

(2) 
Posting of signs; enforcement.
(a) 
The Kingston Department of Public Works is hereby authorized to post Pennsylvania Department of Transportation approved regulatory signs on property standards to advise motorists of the two-hour parking limitation of South Dawes Avenue in the location previously prescribed between the hours of 8:00 a.m. and 5:00 p.m., Eastern daylight saving time. Furthermore, in line with the removal of the parking limitation on North Dawes Avenue, the Kingston Department of Public Works is hereby authorized to remove those signs relating to the parking limitation of North Dawes Avenue.

(b) 
The Kingston Municipal Police Department is hereby authorized to enforce the parking limitation as herein set forth.
(c) 
The placement of appropriate approved signage on the north side of Reynolds Street is hereby authorized and directed.

C. 
Parking prohibited certain hours.

(1) 
Parking is prohibited on the west side of Mercer Avenue from the northerly sideline of West Bennett Street to the southerly sideline of Eley Street between the hours of 7:00 p.m. and 6:00 a.m. prevailing time.

Penalties for violation. Any person who shall violate any provision of this section shall be subject to a penalty as set forth in Municipal Code § 170-29E.

A. 
It shall be unlawful for any person to park any vehicle or to allow the same to remain parked during any period of time in any area posted for street sweeping or cleaning purposes.
B. 
One-way streets.

(1) 
The following streets are one-way streets and are sufficiently narrow as to only allow parking on one side of the street and travel in a single available lane, thereby requiring special parking regulations on street sweeping days.
(a) 
Chestnut Avenue: one way south from Division Street to West Market Street.
(b) 
Elm Avenue: one way north from Pringle Street to Division Street.
(c) 
Eno Street: one way west from Brook Street to Zerby Avenue.
(d) 
Newitt Place: one way west from Chestnut Avenue to Schuyler Avenue.
(e) 
North Maple Avenue: one way north from West Market Street to Price Street.
(f) 
North Sprague Avenue: one way south from Pringle Street to East Hoyt Street.
(g) 
Ross Street: one way east from Schuyler Avenue to Chestnut Avenue.
(2) 
When the posted "parking" side is to be cleaned and parking thereby prohibited, vehicles shall be allowed to park on the traveling lane side of the street from one hour before the stated hour for street sweeping to be commenced until one hour after the posted hours for street sweeping.
(3) 
Parking on the traveling side of the street is otherwise prohibited.
(4) 
Signs informing the public of this regulation shall be posted beneath the street sweeping sign.

Blocking any lane of traffic or driveway.

All vehicles not parked parallel to the curb and within 12 inches therefrom, unless marked by diagonal lines or signs indicating diagonal parking.

Parking on sidewalk or tree lawns.
(13) 
Parking on private property.
E. 
Fines of $50 shall be imposed for the following:

(1) 
Parking in a handicapped zone without authorization, as prohibited and regulated by §§ 1338 and 3354 of the Pennsylvania Motor Vehicle Code, 75 Pa. C.S.A. §§ 1338 and 3354.
(2) 
Street sweeping - third and all subsequent offenses during the yearly street sweeping season as announced by the Administrator of the Municipality of Kingston.

F. 
Increase of fines.

(1) 
Fines of $5 imposed by this article shall be increased to $10 if not paid within 48 hours from issuance of notice of violation.
(2) 
Fines of $10 imposed by this article shall be increased to $15 if not paid within 48 hours from issuance of notice of violation.
(3) 
Fines of $15 imposed by this article shall be increased to $20 if not paid within 48 hours from issuance of notice of violation.
(4) 
Fines of $50 imposed by this article shall be increased to $55 if not paid within 48 hours from issuance of notice of violation.
(5) 
All such fines not paid within 10 days from issuance of notice of violation shall result in the issuance of a citation therefor.
G. 
The Municipal Secretary is hereby authorized to provide for and secure appropriate notice of violation for use by the Municipality of Kingston's Police Department, pursuant to the provisions of this article.
