A.
It shall be unlawful for any person or persons to remove,
cover up or interfere with, in any manner whatsoever, any public monument
or landmark upon or the line of the public street, alley, highway, parks,
squares and on private property, for the purpose of locating or fixing the
lines of the public streets, alleys, highways, parks and squares in the Borough
of Tarentum.
B.
Provided, however, that whenever necessary to remove
or replace a public monument or landmark in the making of public improvements,
said monument or landmarks shall be removed or replaced by the Borough Engineer;
also, whenever necessary to remove or replace such monuments or landmarks
by a contractor in the making of a public improvement, application shall be
made to the Borough Engineer, who shall do the work at the cost and expense
of the applicant.
Any person or persons violating the terms of this chapter, upon conviction
before the Mayor or any District Justice, may be sentenced to pay a fine of
not more than $600 and, in default to payment of fine costs, may be committed
to the borough lockup for a period of not exceeding 30 days or to the county
jail or workhouse for a period of not exceeding 30 days.
