A.
Removal of snow and ice.
(1)
The owner, occupier, or tenant of every property fronting
upon or alongside of any of the streets in the Borough of Lehighton
is hereby required to remove or cause to be removed from all of the
sidewalks in front or alongside of such property all snow and/or ice
thereon fallen or formed within 48 hours after the same shall have
ceased to fall or to form. All sidewalks shall be cleared of snow
and/or ice accumulation to a minimum width of 36 inches or any greater
minimum width which may be required in the future by the Americans
with Disabilities Act or any other federal or commonwealth statute
or regulation relating to handicapped accessibility. This provision
shall not apply to the removal of ice where the owner, occupant, or
tenant shall have provided for adequate traction (note that ice-melt
itself is not sufficient) upon such sidewalk.

The owner of a property shall be responsible for complying
with the provisions of this section where such property is occupied
by the owner, is vacant or unoccupied or is a multiple-business or
multiple-dwelling property with more than one tenant or occupant;
the tenant or occupant of a property shall be responsible therefor
where such property is occupied only by such tenant or occupant.
B.
Disposal of snow and ice.
(1)
Disposal of snow from property other than sidewalks.
No person, including but not limited to the owner, occupier or tenant
of any property within the Borough of Lehighton, may dispose of any
accumulation of snow and/or ice from any property (other than sidewalks)
upon any sidewalks, streets or alleys of the Borough, including but
not limited to the sidewalks, streets or alleys adjoining such property.
(2)
Disposal of snow from sidewalks. No person, including
but not limited to the owner, occupier or tenant of any property within
the Borough of Lehighton, may dispose of any accumulation of snow
and/or ice from any sidewalks in the Borough or elsewhere onto either
the traveling portion of any adjoining sidewalks, streets or alleys
of the Borough or onto any portion of any sidewalks, streets or alleys
of the Borough which have previously been cleared of snow. In addition,
no person, including but not limited to the owner, occupier or tenant
of any property within the Borough of Lehighton, may dispose of any
accumulation of snow and/or ice from any sidewalks in the Borough
or elsewhere in such a manner as to impede, hinder or prevent the
removal of parked vehicles or the parking of vehicles on any such
streets and alleys or in such a manner as to impede, hinder or prevent
pedestrian traffic on the sidewalks of the Borough.
A.
Failure to remove snow and/or ice from sidewalks. In any case where the owner, occupant or tenant, as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of § 192-2A of this Article within the time limit prescribed therein, the Borough authorities may immediately proceed to clear all snow and/or ice from the sidewalk of such owner, occupant or tenant, as the case may be, and to collect the expenses thereof, with any additional amount allowed by law, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under Article VIII of this chapter.
B.
Improper disposal of snow and or ice. In any case where any person disposes of snow and/or ice contrary to the provisions of § 192-2B of this Article, the Borough authorities may immediately proceed to clear all such improperly disposed snow and/or ice and to collect the expenses thereof, with any additional amount allowed by law, from such person, which may be in addition to any fine or penalty imposed under Article VIII of this chapter.
