By adoption of this article, the Town Board of the Town of Olive declares
its intent to be to prohibit and regulate in the manner consistent with the
interest of the citizens of the Town of Olive the dumping of garbage, rubbish,
refuse and similar waste material on lands within the town.
As used in this article, the following terms shall have the meanings
indicated:
Includes topsoil, subsoil, shale, stone, gravel and run-a-bank.
Includes waste food, papers, dead animals or parts thereof, shavings,
straw, shells, cinders, vegetables, dirt and vegetable matter of any kind
or any other matter which is flammable or capable of decay.
Includes an individual, group, firm, corporation, association of
persons, partnership and society, and the singular number shall include the
plural number.
Includes waste metal, metal cans, ashes, cinders, glass, pottery,
chemical waste, wood, lumber and all discarded substances of a solid nature.
A.
No person shall throw, cast, lay, bury or direct, suffer
or permit any agent or employee to throw, cast, lay, bury or leave any rubbish
or garbage of any kind whatsoever in, upon or adjoining any highway, public
roadway or any route of public travel in the Town of Olive, Ulster County,
New York, or any other place in the said Town of Olive except a person's own
private property. No person shall operate the business of a landfill on his
own private property without complying with the rules, regulations and conditions
as the Town Board may from time to time prescribe and in addition thereto,
said person must comply with all federal, state and county rules and regulations
for the operation of a landfill.
B.
Any person desiring to operate a landfill located within
the Town of Olive shall obtain from the Town Clerk a license therefor and
shall comply with all the rules and regulations set forth by the Town Board
of the Town of Olive. Each person applying for such license shall pay to the
Town Clerk an annual fee to be determined by the Town Board at its annual
reorganizational meeting, plus direct expenses incurred by the Town of Olive.
No person shall carry or leave, or cause to be carried or left upon the dumping ground defined in § 125-3 of this article, any garbage as heretofore defined or any material of any kind which creates or may thereafter create a nuisance of any kind, or which shall be, or may become dangerous to human or animal life.

A.
No person shall place any rubbish, garbage or any other
article upon public property, or any private property other than his own,
without the express permission of the owner.
B.
The only exception shall be articles which the owner
reasonably expects to be placed in a container for the use of guests or business
invitees.

Any resident or person conducting an established business in the Town of Olive other than the garbage collecting business defined in § 125-2 above shall obtain a permit from the Town of Olive before depositing waste at the transfer station. Said permit shall be good for one year from date of issuance and shall be subject to change by Town Board resolution.
A.
No person not a resident of, or conducting an established
business in the Town of Olive shall deposit on a designated dumping ground
any garbage, rubbish or other articles originating elsewhere than in the Town
of Olive, Ulster County, New York.
B.
No person shall collect and deposit any garbage, rubbish
or waste materials of any kind which originates outside the bounds of the
Town of Olive, Ulster County, New York, on a designated dumping ground or
on any other property, public or private, in the Town of Olive.
No person shall deposit, or cause to be deposited, any substance of
any kind on a designated dumping ground, except in the places, time and in
the manner directed by the person in charge of the dumping ground under the
authority of the Town Board, whether such direction is given personally or
by a sign or signs erected upon the dumping ground by his authority.
Any and all vehicles used for the collection and/or transportation of
garbage, rubbish and other articles while traveling on the public highway
of the Town of Olive shall be constructed and/or covered so as to prevent
any of the materials thereon from falling on the road or blowing from said
vehicles.
Nothing in this article shall prohibit the Town Board of the Town of Olive from entering into a mutually beneficial contract with another municipality as is provided in Article 9, § 1 of the New York State Constitution and Article 5-G of the General Municipal Law of the State of New York.

Any person who commits or permits the commission of any act or acts
in violation of any of the provisions of this article shall be subject to
a fine of not less than $50 nor more than $250 for each such violation. The
license and/or permit of said violator shall be revoked for a period of three
months for each such violation.
