[HISTORY: Adopted by the Board of Trustees of the Village of Brewster 11-14-1990 (Ch. 67 of the 1992 Code). Amendments noted where applicable.]
This chapter contains regulations in relation to the storage and sale of Christmas trees and related holiday decorations.
The Village of Brewster Board of Trustees is desirous of establishing regulations and procedures for the outdoor sale of Christmas trees and related holiday decorations in the Village of Brewster, New York.
Any person who stores or sells Christmas trees and related holiday decorations in the Village of Brewster shall have a license therefor.
All applications for a license that allows the outdoor storage and sale of Christmas trees and related holiday decorations shall be made to the Village Building Inspector on a form prescribed by him.
The application shall be accompanied by a plan, drawn to scale, showing the general location of the lot where such storage and sales are to take place and trees and other items for sale and also showing provisions for site access and parking, together with written consent of the owner of the lot.
Within 10 days after the application has been fully submitted, the Building Inspector shall approve, with conditions, said application and issue a temporary license or disapprove the application. If the application is disapproved, the Building Inspector shall state his reasons for disapproval in writing.
The application shall be accompanied by a nonrefundable processing fee, plus a site restoration fee, as set forth in the Village fee schedule set from time to time by resolution of the Village of Brewster Board of Trustees. The site restoration fee shall be refunded in full within one week after the termination of the license, provided that the lot on which the trees were sold has been cleaned up and restored to a condition that existed prior to the temporary sale, as determined by the Building Inspector, or refunded in full if the application is disapproved.

All licenses shall commence on November 15 and shall terminate on December 30.
Religious and not-for-profit organizations shall not be subject to the above license and site restoration fees.
Any person committing an offense against any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punishable for each offense by a penalty of not more than $250 or by imprisonment for not more than 15 days, or both.

This chapter shall be enforced by any official authorized to issue and serve appearance tickets under Chapter 4, Appearance Tickets, of the Code of the Village of Brewster or the laws of the State of New York.
