Town of Holland, WI Building Construction

Pursuant to § 101.65, Wis. Stats., the Town Board of the Town of Holland does hereby ordain a building code for new one- and two-family dwellings as follows.

§ 150-2 Purpose.

The purpose of this article is to:

Exercise jurisdiction over the construction and inspection of new one- and two-family dwellings;

Provide for plan review and on-site inspections performed by persons or agencies certified by the Department of Commerce;

Establish and collect fees to defray the costs of exercising jurisdiction under this article; and

Provide remedies and penalties for violations of this article.

§ 150-3 Adoption of state codes.

Chapter Comm 22, Wis. Adm. Code, as adopted and effective December 1, 1978, and Chs. Comm 20, 21, 23, 24 and 25, Wis. Adm. Code, as adopted and effective June 1, 1980, and all amendments to the foregoing regulations, are adopted and incorporated by reference.

§ 150-4 Building Inspector.

There is hereby created the position of Town Building Inspector, who shall administer and enforce this article and who shall be certified by the Department of Commerce as specified by § 101.66(2), Wis. Stats. This appointment shall be made by the Town Board Chairperson, subject to the approval of the Town Board.

§ 150-5 Building permit required.

No person, partnership, association or corporation shall build or cause to be built any one- or two-family dwelling without first obtaining a state uniform building permit for such dwelling from the Town Building Inspector.

§ 150-6 Building permit fees.

Building permit fees shall be determined by the Town by resolution.

§ 150-7 Violations and penalties.

The enforcement of this article and all other laws and regulations relating to buildings shall be by means of the withholding of building permits, imposition of forfeitures and/or injunctive action as specified by § 62.23(9), Wis. Stats., or as otherwise provided by law. Any person, firm, company, corporation, owner, occupant, or other user of the premises who or which violates, disobeys, omits, neglects, resists, or refuses to comply with the enforcement of any provisions of this article shall be subject to a forfeiture of not less that $5 and no more than $2,000 and costs. Each day that a violation is permitted to exist shall constitute a separate offense.

Article II Commercial Building Code

§ 150-8 Statutory authority.

Pursuant to the authority granted under § 101.12, Wis. Stats., the Town adopts this article to promote the general health, safety and welfare by enforcing and adopting the Commercial Building Code of the State of Wisconsin.

§ 150-9 Adoption of state codes.

The following chapters of the Wisconsin Administrative Code, their reference codes and standards, and subsequent revisions are adopted for municipal enforcement by the State Building Inspector, who shall be commercially certified by the Wisconsin Department of Commerce, Division of Safety and Buildings:

Chapter Comm 5, Licenses, Certifications and Registrations.

Chapters Comm 61 to 65, Commercial Building Code.

Chapters Comm 75 to 79, Existing Buildings Code.

Chapter Comm 70, Historic Building Code.

§ 150-10 Building Inspector to be certified.

The State Building Inspector, authorized by the municipality to enforce the adopted building codes noted in § 150-9 above, shall be properly certified by the Wisconsin Department of Commerce, Division of Safety and Buildings.

§ 150-11 Building permit required.

No person shall build or cause to be built any new public building or alter a public building without first submitting plans and specifications to the Town Building Inspector and obtaining a building permit for such a building.

§ 150-12 Building permit fees.

Building permit fees shall be determined by the Town by resolution.
