[HISTORY: Adopted by the Board of Supervisors of the Township of
Upper Southampton 1-21-1986 as Ch. 1, Part 3, of the 1986
Code. Amendments noted where applicable.]
The office of Township Manager is hereby created by the Board of Supervisors
of the Township of Upper Southampton, Bucks County, Pennsylvania.
As soon as practicable after the enactment of this chapter, the Board
of Supervisors of the Township of Upper Southampton shall elect, by a majority
vote of all of its members, one person to fill the office of Township Manager
who shall serve for a specific term to be established at the time of said
election and until a successor is elected and qualified; provided, however,
that the Township Manager shall be subject to removal at any time by a majority
vote of all the members of the Board of Supervisors.
The Manager shall be chosen on the basis of executive and administrative
abilities, education, experience and knowledge with respect to accepted practices
of the duties of the office as herein outlined.
Before entering upon the duties of Township Manager, a bond shall be
given to the township with a bonding company as surety, to be approved by
the Board of Supervisors, in a sum as set from time to time by resolution
of the Board of Supervisors, conditioned for the faithful performance of the
duties of Township Manager, premium for the said bond to be paid by the Township
of Upper Southampton.
The salary of the Township Manager shall be fixed from time to time
by resolution of the Board of Supervisors.
A.
The Township Manager shall be the Chief Administrative
Officer of the township and shall be responsible to the Board of Supervisors
of Upper Southampton Township as a whole for the proper and efficient administration
of the affairs of the Township of Upper Southampton. The powers and duties
shall relate to the general management of all township business not expressly
by statute, ordinance or resolution imposed or conferred upon other township
officers.
B.
Subject to recall by ordinance, the powers and duties
of the Township Manager shall include the following:
(1)
The supervision of and responsibility for the activities
of all municipal departments, except such departments the supervision of which
shall not have been delegated to the Manager by the Board of Supervisors.
(2)
Subject to approval of the Board of Supervisors, the
hiring and, when necessary in the best interests of the township, the suspension
or discharge of any employee under the supervision of the Township Manager;
provided, however, that the Manager shall report, in writing, to the Board
of Supervisors, any action contemplated by authority of this subsection.
(3)
The preparation and submission to the Board of Supervisors
before the close of the fiscal year, or on such alternate date as the Board
of Supervisors shall determine, a budget for the next fiscal year and an explanatory
budget message. In preparing the budget the Manager shall obtain from the
head of each department, agency, board or officer estimates of revenues and
expenditures and other supporting data; the Manager shall review such estimates
and may revise them before submitting the budget to the Board of Supervisors.
(4)
The Township Manager, in addition to the foregoing, shall
undertake and perform the following responsibilities:
(a)
Administration of the budget after its adoption by the
Board of Supervisors.
(b)
Administration of any other municipal office or department
as the Board of Supervisors may from time to time direct.
(c)
Preparation of the agenda for each meeting and supplying
facts pertinent thereto.
(d)
Keeping the Board of Supervisors informed as to the conduct
of township affairs; submitting periodic reports on the condition of the township's
finances and such other reports as the Board of Supervisors requests; and
making recommendations in writing to the Board of Supervisors deemed advisable
in the best interests of the township.
(e)
Submission to the Board of Supervisors, as soon as possible
after the close of the fiscal year, of a complete report on the financial
and administrative activities of the Township of Upper Southampton for the
preceding year.
(f)
Seeing that the provisions of all franchises, leases,
permits, and privileges granted by the Township of Upper Southampton are observed.
(g)
Attending to the letting of contracts in due form of
law, and supervision of the performance and faithful execution of the same
except insofar as such duties are expressly imposed upon other township officers
by statute.
(h)
Collecting promptly all moneys owed to the township and
seeing to the security and collection of all township claims.
(5)
The Township Manager shall attend all meetings (regular,
special and executive) of the Board of Supervisors and of its committees.
(6)
The Township Manager may employ, by and with the approval
of the Board of Supervisors, experts and consultants to perform work and to
advise in connection with any of the functions of the Board which are within
the duties of the Township Manager.
(7)
The Township Manager shall be the purchasing officer
of the Township of Upper Southampton and shall purchase, in accordance with
the provisions of the Second Class Township Code,[1] all supplies and equipment for the various agencies, boards, departments
and other officers of the Township of Upper Southampton; shall keep an account
of all purchases and shall, from time to time or when directed by the Board
of Supervisors, make a full written report thereof; and shall issue rules
and regulations, subject to the approval of the Board of Supervisors, governing
the requisition and purchasing of all municipal supplies and equipment.

(8)
All complaints regarding services or personnel of the
Township of Upper Southampton shall be referred to the office of the Township
Manager, who shall investigate and dispose of such complaints and make a written
report thereon to the Board of Supervisors.
If the Manager becomes ill or needs to be absent from the township,
the Board of Supervisors shall designate one qualified member of the township
staff who shall perform the duties of the Manager during such absence or disability.
