The owner or other person in charge or possession of any property or private parking lot on which a vehicle is parked or left unattended in violation of the provisions of § 353 of the Vehicle Code (75 Pa. C.S.A. § 3353) may remove or have removed the vehicle at the reasonable expense of the owner of the vehicle; and the person who removes the said vehicle shall have a lien against the owner of the vehicle in the amount of the reasonable value of the costs of removing the vehicle, provided:
A. 
The property upon which the vehicle is parked or left unattended is posted with public notice signs to notify the public of any parking restrictions.
B. 
The operator of the vehicle violates such posted restrictions.
C. 
The legend on the public notice signs posted on the property indicates the name and address of the owner of the property, the parking restrictions, a warning that a vehicle left in violation of the restriction may be towed away, the name and address of the towing company or person, the name and address of the place where the vehicle will be towed and stored, and the applicable towing and storage charges.
D. 
The public notice sign shall generally be erected at each entrance to the private parking lot and positioned so as to face traffic which attempts to enter the lot. If there are not designated entrances such as when a lot has one or more sides continuously open to a roadway, then one or more signs shall be erected so as to be readily visible to an ordinarily observant driver.
E. 
The size of the public notice signs shall be as follows:
(1) 
The parking restrictions shall have a minimum height of three inches, except signs erected at a distance of more than 75 feet from the entrance point shall have legend which is at least one inch in height for each twenty-five-foot interval in the distance. The stroke width of the legend shall be a minimum of 1/8 of the required height of the legend.
(2) 
All other required information shall have minimum dimensions of 1/2 of the values required for the parking restriction, but the height of the legend may not be less than two inches.
(3) 
The gross surface area of each sign shall be eight square feet.
F. 
Signs which have application during hours of darkness shall have a reflectorized sign legend or background and be positioned so as to be illuminated by the headlight beams of entering vehicles, or the sign may be illuminated during applicable hours of darkness so as to be readily visible to an ordinarily observant driver.
G. 
The towing, removal and storage of vehicles shall be done only by approved storage garages as shall be designated from time to to time by the Board of Supervisors pursuant to § 171-4 of the Code.
Any person violating any provision of this article is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of not more than $1,000 or, in default thereof, may be sentenced to the county jail for a period not exceeding 30 days.
