This article shall be known and cited as the
"West Deer Township Ordinance Requiring Landlords of Property Within
the Township to Report Any Change of Tenants and Employers Within
the Township To Report Any Change of Employees."
It is not intended by this article to repeal,
abrogate, annul or in any way impair or interfere with existing provisions
of other laws or ordinances, except those specifically repealed by
this article. Where this article imposes a greater restriction upon
persons, premises or personal property than is imposed or required
by such existing provisions of laws or ordinances, the provisions
of this article shall control. The sole purpose of this article is
to aid the Township of West Deer in maintaining up-to-date tax roles.
For purposes of this article, the following
terms, phrases and words shall have the meanings set out herein. When
not inconsistent with the context, words used in the singular number
include the plural number.
EMPLOYER
A person, partnership, association, corporation, institution,
governmental body or unit or agency; or any other entity employing
one or more persons for a salary wage, commission or compensation.
The term shall not include those who hire domestic servants.
LANDLORD
Any person, partnership, association, corporation, institution,
governmental body or unit, rental agent, real estate broker, agency
or any other entity which holds out for lease, on a residential or
commercial basis, real estate located in the Township of West Deer.

Every employer shall, within 30 days after the
effective date of this article or within 30 days after first becoming
an employer, register with the Tax Collector the employer's name and
address and the employee's name and address. Every employer shall
thereafter report changes of employees within 30 days of such change.
Every landlord shall, within 30 days after the
effective date of this article or within 30 days after first becoming
a landlord, register with the Tax Collector the landlord's name and
address and the tenant's name and address. Every landlord shall thereafter
report changes of tenants within 30 days of such change.

Any person, partnership or corporation who or
which has violated or permitted the violation of any provision of
this article, upon being found liable therefor in a civil enforcement
proceeding commenced by the Township, shall pay a judgment of not
more than $600, plus all court costs. No judgment shall commence or
be imposed, levied or payable until the date of the determination
of a violation by a Magisterial District Judge. If the defendant neither
pays nor timely appeals the judgment, the Township may enforce the
judgment pursuant to the applicable rules of civil procedure, at which
time, in addition to any penalties, the violator shall be liable for
any attorneys’ fees and costs incurred by the Township. Each
day that a violation continues or each section of this article which
shall be found to have been violated shall constitute a separate violation.
