As used in this chapter, the following terms shall have the meanings
indicated:
Any activity or condition not legally authorized or privileged which
by its continued existence is the cause of annoyance, offense or inconvenience
to the general public so much so as to be detrimental either to the public
health or general welfare of the inhabitants of the community.
Any natural person, partnership, association, firm or corporation.
The singular shall include the plural and the masculine shall include the
feminine and the neuter.
Under the direction of the Board of Health, the Health Inspector, in
his official capacity, shall be in charge of the enforcement of this chapter
and shall act as prosecutor in any and all cases of violation of the provisions
of this chapter or other ordinances of the Borough of Coopersburg and/or state
statutes relating to the abatement of nuisances found to be detrimental to
the public health and safety.
A.
It shall be the duty of the Health Inspector, or such
person designated by the Borough Council, to make periodic sanitary inspections
of the streets and alleys as well as any premises in the Borough of Coopersburg
at any such time as directed by the Board of Health and to report to the Board
of Health any and all evidence or reports of conditions alleged to be detrimental
to the public health and safety. Such person shall also, at the direction
of the Board of Health, upon the complaint by Borough residents, make special
investigation of alleged nuisances and report concerning the same to the Board
of Health. Such person shall serve all notices of abatement issued by the
Board of Health, perform duties regarding the abatement of nuisances as the
Board of Health may direct and execute the orders of the Board of Health.
While acting in the performances of duties, such person shall have the powers
and authority of a police officer.
B.
All duties and responsibilities of a Health Officer as
set forth under any relevant state statute, including the Pennsylvania Health
Code, are hereby incorporated into this chapter.
No person shall maintain or permit to be maintained on any property
owned or occupied by, within the Borough of Coopersburg, any condition detrimental
to the public health and safety or so found to be after investigation by the
Board of Health upon the receipt of a notice from the Board of Health that
such a condition exists on a property owned or occupied by. It shall be that
person's duty to abate the specified nuisance to the satisfaction of
the Board of Health within the time limit specified in said notice.
Any person who shall violate any of the provisions of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not more than $1,000
and cost of prosecution and, in default of payment of such fine and costs,
to imprisonment of not more than 30 days; provided: each day's continuance
of a violation shall constitute a separate offense; provided further: such
fine and costs may be in addition to the costs and expenses of abatement of
any nuisance created or maintained as a result of such violation, and any
penalty authorized to be charged in addition to such costs and expenses, in
cases where abatement thereof is done by the Health Inspector or a nominee
of the Borough Council.
