The following words, when used in this article, shall have the meaning ascribed to them in this section, except in those instances where the context clearly indicates otherwise:
ASHES
The residue from the burning of wood, coal, coke, charcoal, infectious waste (as defined in 25 Pa. Code § 271.1) or other combustible materials for the purposes of heating and/or cooking.
CONTAINER
An appropriate carrier for the retention of refuse prior to collection. Appropriate carriers are metal or plastic cans, not to exceed twenty-gallon capacity, with tight fitting lids, plastic bags (1.5 mil minimum thickness) which have been tightly and securely closed, or such other container(s) as the Board of Health may from time to time approve. No container should exceed 50 pounds gross weight.
EQUIVALENT DISPOSAL UNIT (EDU)
The amount of refuse to be collected from the average unit during an average week. One EDU is hereby defined as four twenty-gallon containers per week, or the equivalent. One 20 gallon container is equivalent to one 30 gallon plastic bag, or one bundle or box of rubbish not to exceed four feet in length, six feet in perimeter or circumference (as applicable), and 50 pounds in gross weight.
GARBAGE
The animal and vegetable waste resulting from the storage, handling, preparation and consumption of food. It shall not include more than a minimal amount of free liquid(s).
PERSON
A natural person, firm, partnership, joint venture, association, and/or corporation.
REFUSE
Garbage, ashes, and rubbish as defined herein.
REFUSE PRODUCING SOURCE
Any number of persons, individually or as a group, is the basis of one refuse producing source (RPS). For example, in an apartment house, each dwelling unit constitutes one refuse producing source.
RUBBISH
All waste materials not included in garbage or ashes, except rubbish from building construction or reconstruction, grass clippings, street refuse, industrial refuse, abandoned large machinery or vehicles, dead animals, infectious waste (as defined in 25 Pa. Code § 271.1) or such other waste materials as are not commonly produced in homes, stores or institutions.
TRUCK TIRES
A tire 15 inches in diameter or more. Any tire less than 15 inches in diameter shall be considered a car tire.

A. 
Authority. The accumulation, collection and disposal of refuse in the Borough of Coopersburg shall be under the supervision of the Board of Health and the Coopersburg Police Department. Subject to the authority of Borough Council, the Board of Health and the Coopersburg Police Department shall have authority to enforce the provisions of this article and take all such action authorized by this article or by statutory authority devolving upon it.
B. 
Disposal by nonresidents. Any nonresident of the Borough of Coopersburg who shall dispose of refuse by placing the same upon Borough streets or private property for Borough pickup shall be committing an unlawful act and shall be subject to the penalty provisions of this article, as well as any other Borough ordinance or state laws pertaining to the foreseeable consequences of such unlawful acts.
C. 
Rules and regulations promulgated by Board of Health. All refuse accumulated in the Borough of Coopersburg shall be subject to care and removal under the terms of this article or other rules and regulations promulgated by the Board of Health and shall be collected, conveyed and disposed of only with the approval of Borough Council. The cost of such service for the care and removal of refuse shall be paid for as provided in the schedule of fees set forth in § 182-6 hereof by the person or persons producing the refuse, or responsible for the existence or disposal thereof, or for whom such refuse is removed. It shall be unlawful for any person to collect or convey over any of the streets or alleys of the Borough, or dispose of any refuse accumulated in the Borough except with permission of Borough Council. Owners of premises desirous of personally disposing of refuse or hiring an alternate contractor shall first apply for and be granted permission by Borough Council to make such personal disposal of their own refuse after having satisfied Borough Council of their compliance with the special regulations of the Borough for such activity as set forth below.
D. 
Alternate disposal must be approved by Council. The producers of refuse or the owners of premises upon which refuse is accumulated who desire personally to collect and dispose of such refuse or to hire an alternate contractor shall: Show cause why the use of the Borough of Coopersburg collection system works a hardship upon them; and establish to the satisfaction of the Borough that hauling will be performed under an agreement with a commercial hauler having access to a legal dumping site [or show evidence (including dumping permits) of his ability to personally haul and dispose of rubbish at a legal dumping site]; and that in all other matters involving collection practices they will conform to the provisions of this article. The Board of Health shall have authority to make investigations concerning individual disposal as it may be directed or deemed necessary.
A. 
Preparation of refuse.
(1) 
All refuse shall be drained of as much liquid content as possible.
(2) 
All garbage shall be wrapped in paper, or placed in paper or plastic bags.
(3) 
All garbage shall then be placed in an approved container.
(4) 
Tree trimmings, hedge clippings, and similar material shall be cut and bundled (or boxed) such as to conform with the specifications set forth in § 182-2C.
B. 
Refuse containers.
(1) 
All containers shall be kept as sanitary as possible in view of the use to which they are put.
(2) 
All refuse containers shall be provided by the owner, tenant, lessee, or occupant of the premises.
(3) 
All refuse containers shall be maintained in good condition. Any container that does not conform to the provisions of this article or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereof shall be promptly replaced upon notice. Failure to comply may result in refusal to collect or the removal of the defective container as refuse.
C. 
Storing of refuse.
(1) 
No person shall place any refuse at the edge of any street, alley or public place, or at the edge of any private property whether owned by such person or not, within the Borough of Coopersburg except it be at proper time and in proper containers for collection or under an express approval granted by the Borough Council. No person shall throw or deposit any refuse in any stream or other body of water.
(2) 
Any unauthorized accumulation of refuse on any premises is hereby declared to be a nuisance and is prohibited. Failure to remove any such refuse within 10 days after notification shall be deemed a violation of this article.
(3) 
It shall be unlawful for any person, other than the occupants of the premises on which refuse containers are stored, or the collector, to remove the covers or any of the contents of refuse containers.
D. 
Points of collection. Refuse containers shall be placed for collection at ground level on the property, not within the right-of-way of a street or alley, and accessible to and not more than 10 feet from the side of the street or alley from which collection is made, unless with the express approval of the Board of Health.

A. 
Frequency of collection. Refuse shall be collected on such days as designated by the Board of Health.
B. 
Limitation of quantity. The normal quantity of refuse to be collected from each RPS is defined as one EDU. The Board of Health may refuse to authorize the collection of larger amounts of refuse or may make an additional charge for such amounts in accordance with § 182-6.
C. 
Special refuse problems.
(1) 
Contagious disease refuse. The removal of wearing apparel, bedding or other refuse from homes or other places where highly infectious or contagious disease has prevailed shall be performed under the supervision and direction of the Board of Health. Such refuse shall not be placed in containers for regular collection.
(2) 
Inflammable, explosive or radioactive refuse. Highly inflammable, explosive or radioactive materials shall not be placed in containers for regular collection but shall be disposed of as directed by the Board of Health at the expense of the owner or possessor thereof.
(3) 
White goods. White goods, including but not limited to refrigerators, dish washers and hot water heaters, shall be subject to being collected by the contractor engaged by the Borough of Coopersburg only upon the purchasing and affixing of a ticket to the aforementioned product. Tickets shall be purchased from the Borough of Coopersburg upon payment of a fee, as established from time to time by resolution of Borough Council, with each ticket to be valid for one white good.
(4) 
Tires. Car and truck tires shall be picked up by the contractor engaged by the Borough of Coopersburg only if the tires have a ticket affixed thereto. Said tickets shall be purchased directly from the Borough of Coopersburg upon payment of a fee, as established from time to time by resolution of Borough Council, with each ticket to be valid for one tire.
All municipal waste produced, collected and transported from within the jurisdictional limits of the Borough of Coopersburg shall be, to the extent permitted by law, disposed of at disposal facilities designated by the Borough of Coopersburg and in accordance with any currently effective solid waste management plan for municipalities within the County of Lehigh of which the Borough of Coopersburg is a participant. In the absence of such designated facilities or a currently effective solid waste management plan, municipal waste from the Borough of Coopersburg must be disposed of at a state-permitted facility.

Fees.
(1) 
The base rate shall apply to the first EDU per RPS with an additional charge of 1/2 of the base rate per EDU per RPS thereafter.

Borough Council may, in lieu of the maintenance of its own garbage collection system administered and conducted by the Board of Health, contract for the exclusive right to collect refuse from refuse producing sources within the Borough. Such contracts shall be awarded from time to time, for such period of time as determined by the Borough Council, to the lowest responsible bidder, following the procedure prescribed by the Borough Code. Such contract shall fix and regulate the manner, method and time of collecting and conveying refuse. The person to whom such contract shall be awarded shall, before undertaking any of his duties hereunder, give bond to the Borough for the faithful compliance with the terms of the contract. Such bond to be in such sum and with such security as Borough Council shall require. All consistent provisions of this article shall continue to be applicable in the event of contract by the Borough under this section.
