Borough of Clarion, PA Article VI Enforcement

§ 174-23 Violation notice.

A. Any person who shall fail, neglect or refuse to comply with any of the terms or provisions of this chapter, or with any rule, regulation or requirement established pursuant thereto, shall be notified, in writing, via certified mail, by the owner to document that a violation of this chapter has occurred. The owner/Manager or his designee shall document when the violation is to be corrected and when reinspection will occur to verify that the violation has been resolved.

B. During reinspection, if the owner/Manager or his designee finds that the violation of this chapter has not been resolved within the time frame specified in the notice, then the person shall be subject to § 174-24 of Article VI.

§ 174-24 Violations and penalties.

Any person who shall fail, neglect or refuse to comply with any of the terms or provisions of this chapter, or with any rule, regulation or requirement established pursuant thereto and authorized thereby, shall, upon conviction before any Magisterial District Judge, be sentenced to pay a fine not to exceed $1,000 per day plus costs of prosecution to the Borough of Clarion and reimbursement of $300 to the owner for costs incurred by it in enforcing this chapter and for damage sustained by its facilities as a result of the violation.
