This article is adopted for the purpose of promoting the orderly and safe parking of motor vehicles within parking areas established by the Township of Marlboro for commuter parking at or near Route 9, within the Township.
A. 
The provisions, rules and regulations of this article pertaining to parking areas are applicable to all those parcels of land and premises which are owned, leased, occupied or controlled by the Township of Marlboro and devoted to the purpose of parking motor vehicles, but do not apply to any lands or area within the right-of-way of any public street, road or highway.
B. 
These provisions, rules and regulations shall also be applicable to any other parcels of land premises owned, leased, occupied or controlled by the Township of Marlboro now or hereafter.

A. 
Unless otherwise permitted by this chapter, parking on said lands and premises designated in § 258-2 shall be permitted by permit only, which shall be evidenced by a permit issued to the owner of the motor vehicle.

B. 
Such parking area shall be marked by signs indicating that parking will be by permit only, Monday through Friday, 4:30 a.m. to 6:30 p.m., and that vehicles must bear the required permit, which signs may state "Parking for Vehicles With Permits Only."

C. 
No vehicle shall be parked in any such parking area unless it displays from the rear view mirror while the vehicle is properly parked in such parking area a current and valid permit issued by the Township of Marlboro as herein provided. Such permit shall be removed from the rear view mirror prior to operation of the vehicle.
D. 
No vehicle shall be parked or remain parked in any such parking area at certain times as may be designated by the Township Council.
E. 
No trailers, trucks or buses shall be parked in any such parking area except only in such space as may be specifically designated for the same.
F. 
All vehicles must be parked in any such area with the front of the vehicle facing the control sign which designates the parking space therefor.
G. 
No vehicle shall be parked within the entrance or exit to any parking area or within any of the aisles thereof.

A. 
Issuance; numbers restricted.

(1) 
Said permits shall be issued by the Business Administrator during the regular hours during which his or her office is open and only upon copies being furnished of:
(a) 
A current and valid motor vehicle registration and insurance certificate.
(b) 
A current gas, water, sewer or electric utility bill dated within the previous 30 days. In order to receive Marlboro or Manalapan resident renewal or registration priority, the bill provided must indicate the name and address of the applicant as a resident of the Township of Marlboro, or as a resident of the Township of Manalapan.
(2) 
The Business Administrator shall issue not more than 150 permits to the residents of the Township of Manalapan on a first-come, first-served basis in any one year.
(3) 
The Business Administrator shall not issue more than two permits to any Marlboro household, and shall not issue more than one permit to any Manalapan or non-resident household.
(4) 
Replacement fee or addition of vehicles. For permit holders requiring a replacement permit or changing vehicles after March 31 and prior to the end of the permit year, a replacement permit may be issued.
B. 
Permits shall be valid from April 1 of the year in which issued to 12:00 midnight of March 31 of the following year. This time period shall be referred to herein as the "permit year."

C. 
Fees.

(1) 
Manalapan residents may apply for a parking permit at any Township commuter parking facility. Nonresidents of jurisdictions other than Manalapan may apply for a parking permit at the Texas Road parking facility, subject to the provisions of § 254-4D(1) and (2), and shall be charged at the rate of $275 per permit year, payable at the time of application.

An additional fee of $25 shall be imposed for the replacement of a permit or addition of vehicles prior to the end of a permit year.

(5) 
Purple Heart designation. Residents of Marlboro who possess a permit for parking under § 258-4C who have obtained a placard from the New Jersey Division of Motor Vehicles for having received a "Purple Heart" designation from the United States Government shall be eligible for a reimbursement of 100% of the cost of a permit under this section. Residents shall submit an application for reimbursement along with the NJDMV placard and Purple Heart citation letter in order to receive reimbursement.

D. 
Permits shall be valid from the date of issue until 12:00 midnight of March 31 of the following year, and shall be charged at the yearly rate specified hereinbefore. The parking spaces of permit holders who fail to renew by April 1 shall be forfeited and offered to applicants maintained on a waiting list and nonresidents.

(1) 
Marlboro and Manalapan parking permit holders shall be entitled to the first opportunity to renew annually, but must do so on or before March 31 of the permit year.
(2) 
Applications for parking permits from nonresidents shall be reviewed following the completion of the renewal process for Marlboro and Manalapan residents, beginning April 1 of the permit year.
E. 
Said permits shall have written thereon "Marlboro Township Parking Permit," together with the number of the permit, the date of expiration of the permit and the license plate number(s) of the vehicle(s) registered. No more than two vehicles shall be listed on said permit.
F. 
The Business Administrator shall make and keep a record of all permits issued, a list of applicants waiting for an available parking space, and the necessary procedures for the administration thereof.

G. 
In the event that a permit holder must use a vehicle whose license plate number is not listed on the permit, the permit holder may park another vehicle registered at the same address as the permit holder, provided that such permit holder gives notice to the Division of Police prior to parking such vehicle.[2]

Further rules and regulations pertaining to such parking areas and to parking of motor vehicles therein may be made from time to time by resolution of the Township Council.
No person shall park or place any disabled vehicle or permit any such disabled vehicle to remain in any such parking area without the express permission of the police or the attendant in charge of such parking area.

A. 
In the case of a violation of any provision of this article, the person so parking and the owner of the vehicle shall be liable to the penalties in § 4-3 of the Code, and each day the violation continues shall be a separate and distinct violation.
B. 
Any vehicle parked in a parking area in violation of this article, except a vehicle displaying a valid permit and parked as not herein required, may be removed from the parking area upon order of any police officer, and the owner thereof shall pay the reasonable cost of such removal and storage which may result from such removal before being allowed to regain possession of the vehicle, and such costs of removal and storage shall be in addition to any penalty or fine hereinbefore provided.
This article shall not apply to any municipal vehicles registered to the Township of Marlboro or to any vehicles engaged in police work.
