A. 
A Shade Tree Committee for the Township of Marlboro is hereby established.
B. 
Membership; term of office; vacancies. The Shade Tree Committee shall consist of nine members who shall be residents of the Township and who shall be appointed by the Mayor. The term of each member of the Shade Tree Committee shall be determined by the Mayor, and members shall serve for their respective terms and until their successors are appointed and qualified. The members of the Shade Tree Committee shall be appointed by the Mayor in January. Vacancies in the membership of the Shade Tree Committee, occurring for whatever cause, shall be promptly filled by the Mayor.
C. 
Compensation. The members of the Shade Tree Committee shall serve without compensation.
D. 
Officers; meetings; bylaws. The Mayor shall choose from among its members a Chairman and such other officers as may be deemed necessary. The Shade Tree Committee shall hold monthly meetings at a date mutually agreed upon by the Committee. The Shade Tree Committee may adopt bylaws and make amendments to such bylaws from time to time, as it may deem necessary.
E. 
Duties. The duties of the Shade Tree Committee shall be as follows:
(1) 
To recommend and act as an advisory board regarding the regulation, planting and care of shade and ornamental trees and shrubbery now located or which may hereafter be planted in any public highway, public park or public lands owned or under the jurisdiction of the Township of Marlboro, including the planting, trimming, spraying, care and protection thereof.
(2) 
To recommend and act as an advisory board regarding the removal of any tree or part thereof dangerous to public safety.
(3) 
To encourage the planting of shade and ornamental trees and shrubbery throughout the Township of Marlboro on public and on private property and to assist the various public boards, bodies and agencies of the Township in their efforts with regard to the encouragement of planting shade and ornamental trees and shrubbery.
(4) 
To prepare, develop and distribute information with respect to the growing of and care for shade and ornamental trees and shrubbery.
(5) 
To recommend and act as an advisory board regarding the treatment or the removal of any trees situated upon private property which are believed to harbor a disease or insects readily communicable to neighboring healthy trees in the care of the Township; and to enter upon private property for that purpose; provided, however, that the consent of the property owner is first obtained in writing, and provided further that the suspected condition is first confirmed by certificate issued by or on behalf of the appropriate state or federal agencies.
(6) 
To make biannual reports to the Mayor setting forth therein and detailing the activities and operations of the Shade Tree Committee during the preceding six months.
F. 
Appropriation of funds. There shall be appropriated in each annual budget of the Township such sum or sums as may be determined by the Township Council to be necessary for the proper operation and functioning of the Shade Tree Committee.
A. 
A Conservation Officer for the Township of Marlboro is hereby established.
B. 
Terms of employment. The Conservation Officer shall be appointed by the Mayor. The Conservation Officer shall be a salaried employee of the Township, to be compensated in accordance with the Code of the Township of Marlboro, and shall be a part of the Department of Community Development, Division of Engineering.
C. 
Qualifications. The Conservation Officer shall have the proper qualifications to undertake the administration and enforcement of this chapter and shall be either a certified tree expert or a professional forester as recognized by the state based on experience, training and licensure.
D. 
Duties; responsibilities. The duties and responsibilities of the Conservation Officer shall be as follows:
(1) 
Inspection of sites for which applications are filed under this chapter;
(2) 
The administration and enforcement of sites for which applications are filed under this chapter;
(3) 
The administration and enforcement of tree removal and protection requirements under this chapter, and
(4) 
The administration and enforcement, generally, of all the provisions of this chapter.
E. 
The Conservation Officer shall report to the Shade Tree Committee on a regular basis and shall act as a liaison between the Shade Tree Committee and the Mayor and governing body of the Township in connection with the provisions, administration and enforcement of this chapter.
F. 
The Conservation Officer shall be a member of the Department of Community Development, Division of Engineering and shall work with the appropriate Land Use Approval Board of the Township of Marlboro as defined hereinbelow, in order to effectuate the provisions of this chapter. Copies of engineering reports, Land Use Approval Board resolutions and other items of record in connection with new development, tree removal and landscaping issues in the Township shall be forwarded to the Conservation Officer for his or her review and action, if appropriate.
G. 
The Conservation Officer may, from time to time, appoint a designee to assist him or her with the duties of Conservation Officer, such designee to be an employee of the Township Division of Engineering and qualified, in the opinion of the Conservation Officer, to assist in conservation matters.
