[HISTORY: Adopted by the Board of Trustees of the Village of Hamilton 5-8-2007 by L.L. No. 3-2007. Amendments noted where applicable.]
This chapter is enacted pursuant to the authority of § 10 of the Municipal Home Rule Law which authorizes villages to adopt a local law which amends or supersedes any provisions of the Village Law in relation to the property, affairs or government of the Village or in relation to any of the other enumerated subject matters in such § 10, unless there is a state legislative restriction on such amendment or supersession.
In order to permit the Village of Hamilton to secure qualified personnel to administer the duties of Inspectors of Election of the Village of Hamilton, it is deemed advantageous by the Board of Trustees of the Village of Hamilton to enact a local law superseding the requirement contained in § 15-116 of the Election Law, § 3-300 of the Village Law and §§ 3 and 30 of the Public Officers Law that the Inspectors of Election of the Village of Hamilton be residents of the Village of Hamilton.
Section 15-116 of the Election Law, § 3-300 of the Village Law and §§ 3 and 30 of the Public Officers Law are hereby amended and superseded in their application to the Village of Hamilton to provide that the Inspectors of Election of the Village of Hamilton at the time of his/her appointment and throughout his/her term of office, need not be an elector or resident of the Village of Hamilton so long as he/she is a resident of the Town of Hamilton. A new sentence is hereby inserted at the end of § 15-116 of the Election Law, at the end of § 3-300 of the Village Law and at the end of §§ 3 and 30 of the Public Officers Law, as those statutes apply to the Village of Hamilton, to read and provide as follows: "The Inspectors of Election of the Village of Hamilton, at the time of his/her appointment and throughout his/her term of office, need not be an elector or resident of the Village of Hamilton so long as he/she is a resident of the Town of Hamilton."

Section 3-300, Subdivision 2, of the Village Law and §§ 3 and 30 of the Public Officers Law are hereby amended and superseded in their application to the Village of Hamilton to provide that the Village Administrator, Village Treasurer, Village Clerk, Village Deputy Clerk, and Village Deputy Clerk Treasurer of the Village of Hamilton, at the time of his/her/their appointment and throughout his/her/their term of office, need not be an elector or resident of the Village of Hamilton so long as he/she/they is/are a resident of the County of Madison or of any county within the State of New York which shares a common county boundary with the County of Madison. A new sentence is hereby inserted at the end of § 3-300 of the Village Law and at the end of §§ 3 and 30 of the Public Officers Law, as those statutes apply to the Village of Hamilton, to read and provide as follows: "The Village Administrator, Village Treasurer, Village Clerk, Village Deputy Clerk, and Village Deputy Clerk Treasurer of the Village of Hamilton, at the time of his/her/their appointment and throughout his/her/their term of office, need not be an elector or resident of the Village of Hamilton so long as he/she/they is/are a resident of the County of Madison or of any county within the State of New York which shares a common county boundary with the County of Madison."
