Editor's Note: This local law also provided
that it shall supersede any inconsistent provision of Town Law § 271.
A.Â
It is the intent of this article to provide for the terms of office
of seven Planning Board members of the Town of Tuxedo, who shall be
appointed to office for terms of five years, pursuant to the authority
of Town Law § 271 and the Municipal Home Rule Law.
B.Â
The revisions contained in this article are intended to correct the
current term discrepancies of the Planning Board.
A.Â
The existing terms of office for Planning Board positions are to
be revised and the new terms of office for all Planning Board positions
are established as follows:
(1)Â
December 31, 2020: The term of office of one Planning Board member
shall expire.
(2)Â
December 31, 2021: The terms of office of two Planning Board members
shall expire.
(3)Â
December 31, 2022: The term of office of one Planning Board member
shall expire.
(4)Â
December 31, 2023: The terms of office of two Planning Board members
shall expire.
(5)Â
December 31, 2024: The term of office of one Planning Board member
shall expire.
C.Â
Alternate
member. The Town Board shall appoint one alternate member whose term
shall be for one year. The alternate member shall fully participate
in all proceedings of the Planning Board, but may vote only when another
member is absent or abstains and a quorum is needed. Any limitation
of the power of such alternate member to vote which may be set forth
in Town Law § 271(15) is hereby superseded.

The Town Board may, by resolution, establish requirements for
training, continuing education and/or attendance. Adherence to these
performance criteria is a requirement for continuing in office as
a Planning Board member.
If any part or provision of this article or the application
thereof to any person or circumstance be adjudged invalid by any court
of competent jurisdiction, such judgment shall be confined in its
operation to the part or provision or application directly involved
in the controversy in which such judgment shall have been rendered
and shall not affect or impair the validity of the remainder of this
article or the application thereof to other persons or circumstances,
and the Town Board of the Town of Tuxedo hereby declares that it would
have passed this article or the remainder thereof had such invalid
application or invalid provision been apparent.
