Editor's Note: This local law also provided that it shall supersede any inconsistent provision of Town Law § 271.
The membership of the Town of Tuxedo Planning Board is hereby increased from five members to seven members pursuant to the authority of Town Law § 271, Subdivision 6.
A. 
Additional members shall be first appointed for single terms as provided by resolution of the Town Board in order that the terms of such members shall expire at the end of calendar year 2014. They or their successors shall be appointed to a new term of five years each thereafter. Pursuant to the Municipal Home Rule Law, this provision shall supersede in its application to the Town of Tuxedo the last full sentence of Town Law § 271, Subsection 4, and the second sentence of Town Law § 271, Subdivision 6.
B. 
Such additional members of the Planning Board may take part in consideration of any matter pending before the Board at the time of the appointment, provided such member has reviewed plans, applications and minutes so as to reasonably familiarize the member with such matter. Pursuant to the Municipal Home Rule Law, this provision shall supersede in its application to the Town of Tuxedo the last full sentence of Town Law § 271, Subdivision 6.
C. 
Members now holding office for terms which expire at the end of calendar year 2014 shall hold office until the end of calendar year 2014. They or their successors shall be appointed to a new term of five years each thereafter. Members now holding office for terms which expire at the end of calendar year 2015 or later shall hold office for terms expiring as currently constituted on the date of adoption of this article, and they or their successors shall be appointed to a new term of five years each thereafter. Pursuant to the Municipal Home Rule Law, this provision shall supersede in its application to the Town of Tuxedo Town Law § 271, Subdivisions 4, 5 and 6.
The Town Board may, by resolution, establish requirements for training, continuing education and/or attendance.
If any part or provision of this article or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this article or the application thereof to other persons or circumstances, and the Town Board of the Town of Tuxedo hereby declares that it would have passed this article or the remainder thereof had such invalid application or invalid provision been apparent.
