A local law regulating and restricting the location, construction and use of buildings and structures and the use of land in the unincorporated area in the Town of Tuxedo, County of Orange, State of New York, repealing Local Law No. 2 of 1966 and all amendments thereto.
This local law shall be known and may be cited as the "Zoning Law of the Town of Tuxedo, New York."
There is hereby established a new comprehensive zoning plan for the Town of Tuxedo, which plan is set forth in the text and map that constitute this chapter. Said plan is adopted for the purposes set forth in Article 16, §§ 261 and 281, of the Town Law, which, in the interest of the protection and promotion of the public health, safety and welfare, shall be deemed to specifically include the following, among others:
To guide and control growth in an orderly efficient manner consistent with the ability of the Town to provide services and facilities necessary to accommodate new growth.
To facilitate the efficient and adequate provision of public facilities and services.
To assure adequate sites for residence, industry and commerce.
To provide privacy for families.
To protect the wetlands, water surcharge areas, streams and lakes from filling, erosion and pollution.
To prevent and reduce traffic congestion, so as to promote efficient and safe circulation of vehicles and pedestrians.
To protect residential areas.
To provide adequate land resources for the housing of all segments of our population.
To gradually eliminate nonconforming uses.
To enhance the appearance of the Town of Tuxedo as a whole.
To encourage flexibility in the design and development of land in such a way as to promote the most appropriate use of lands, to facilitate the adequate and economical provision of streets and utilities, and to preserve the natural and scenic qualities of open lands.
Gaming Overlay (GO). The Gaming Overlay zoning district encompasses properties primarily with frontage on Route 17A located centrally within the Town of Tuxedo and Sterling Forest State Park. The purpose of this overlay zone is to allow a gaming facility licensed by the New York Gaming Facility Location Board, together with resort development uses consisting of a self-contained and fully integrated planned development, in a setting of significant natural amenities, with primary focus on destination resort facilities consisting of transient visitor accommodations associated with a range of developed on-site indoor or outdoor recreational facilities.
