A. 
Unless otherwise provided, any person, firm, or corporation who or which shall violate any of the provisions of this Code or any rule, regulation, or order made thereunder or pursuant thereto shall be guilty of an offense and, upon conviction thereof, be subject to a fine not exceeding $250 or imprisonment for a period not to exceed six months, or both, for a conviction of a first offense; for a conviction of a second offense both of which were committed within a period of five years, punishable by a fine not less than $250 nor more than $500 or imprisonment for a period not to exceed six months, or both; and upon conviction for a third or subsequent offense, all of which were committed within a period of five years, punishable by a fine not less than $500 nor more than $1,000 or imprisonment for a period not to exceed six months, or both. Offenses shall be deemed unclassified misdemeanors.
B. 
Each day during or on which a violation of this Code shall occur shall be deemed a separate and distinct offense, for which separate and additional fines and punishment may be imposed and recovered. To the extent applicable, this provision shall supersede all contrary provisions of the Town Law, including, but not limited, to § 268 thereof.
Unless otherwise provided, any person, firm, or corporation who or which shall violate any of the provisions of this Code or any rule, regulation or order made thereunder or pursuant thereto shall be liable to the Town of Williamson for a civil penalty not exceeding $250 for a first adjudication; for an adjudication upon a second, both of which were committed within a period of five years, a civil penalty of not less than $250 nor more than $500; and upon an adjudication for a third or subsequent violation all of which were committed within a period of five years, punishable by a civil penalty not less than $500 nor more than $1,000.
A. 
Each day continued violation shall constitute a separate additional violation, for which separate and additional civil penalties may be imposed and recovered. To the extent applicable, this provision shall supersede all contrary provisions of the Town Law, including, but not limited to, § 268 thereof.
B. 
In the event the penalty sought is within the monetary jurisdiction of the Justice Court, as established in Article 18 of the Uniform Justice Court Act, such action to recover such penalty may, as shall be determined by the attorney representing the town, be commenced as a small claim pursuant to the provisions of Article 18 of the Uniform Justice Court Act.
In addition to and not in limitation of any power otherwise granted by law, the Town Board or, with its approval, other proper official of the town may institute and maintain any appropriate action or proceeding to prevent, restrain, correct or abate any violation of this Code.
