A. 
Pursuant to § 118, Subdivision 4, of the Agriculture and Markets Law of the State of New York, impoundment fees regarding any dog seized pursuant to § 118, Subdivision 1 or 2, or Chapter 58 of the Williamson Town Code shall be, and the same are hereby as follows:
(1) 
Fifteen dollars for the first 24 hours' impoundment of any licensed dog seized, and $25 for any unlicensed dog seized.
(2) 
Twenty-five dollars for the first 24 hours of any second impoundment of any licensed dog seized, and $40 for any unlicensed dog so seized, within one year of the first impoundment.
(3) 
Fifty dollars for the first 24 hours of any third and subsequent impoundment of any licensed dog seized, and $60 for any unlicensed dog so seized, within one year of the first impoundment.
(4) 
Three dollars for each additional 24 hours or part thereof following any impoundment of any dog, licensed or unlicensed.
(5) 
Ten dollars per day (for 10 days), for any dog, cat or ferret suspected of having rabies. Payment of the impound fee must be made within two business days of the animal being impounded. If said fee is not paid within two business days, the animal will be sent to the laboratory at the owner's expense, for further rabies testing.
B. 
The Town Board of the Town of Williamson is hereby authorized and empowered to amend by resolution, and as may be permitted by state law, any of the fines or fees to be imposed in this chapter when such provisions have been adopted by the Town Board, at any meeting of said Board duly held and caused to be published in the official newspaper for the Town. Any such provision so adopted shall become effective upon the publication of said provisions in the official newspaper unless otherwise determined by the Town Board.
All other local laws and articles of the Town of Williamson inconsistent with the provisions of this article are hereby repealed; and the impoundment fees herein established shall supersede those otherwise prescribed in § 118 of the Agriculture and Markets Law of the State of New York.
