If the Water Utilities Department shall find any conditions to exist which create a hazard or danger to the health of the community or the neighboring properties, it shall determine the cause thereof and shall issue such stop orders or directives to the person or persons causing such situation as it shall determine necessary, and it shall immediately report such conditions to the Town Board, which shall take such action as it deems appropriate. The failure of any person to comply with a lawfully issued stop order or directive of the Water Utilities Department or the Town Board hereunder shall constitute a violation of this Part 2.
Any person violating any provision of this Part 2 shall be responsible in money damages for any injury to the water system or expense caused by the town by such violation. This money may be collected by civil action in any court of competent jurisdiction. Obedience to this Part 2 may also be enforced by injunction.
Any person violating any provisions of this Part 2 and interfering with, entering or using said water system without obtaining permission hereunder shall be guilty of an offense and subject to a fine of not less than $50 nor more than $250 or to imprisonment of not less than one day nor more than six months, or both such fine and imprisonment; and in addition, when a violation of this Part 2 or any of the provisions thereof is continuous, each 24 hours thereof shall constitute a separate, distinct and additional violation.
The malicious, willful or negligent breaking, damaging, destruction, uncovering, defacing or tampering with any structure, appurtenance or equipment that is part of the water system shall be a violation of this Part 2, and any person violating this section shall be subject to the fines herein provided and shall be liable for any damage or loss suffered by the town arising therefrom.
