Editor's Note: Local Law No. 5-2016, adopted 5-3-2016, changed the title of this chapter from "Skateboards and Roller Blades" to "Portable Sports Apparatus." Said chapter was subsequently renumbered from Ch. 111 to Ch. 96 to maintain the organization of the Code.
As used in this chapter, the following terms shall have the meanings indicated:
HOVERBOARD
A narrow horizontal board with wheels at each end, on which a person may stand upright.

ROLLER BLADES
A single platform which is mounted on a single roll of wheels running from front to rear and having no mechanism or other device with which to steer or control the direction of movement thereof while being used, operated or ridden.
SEGWAY®
A two-wheeled, self-balancing personal transporter.

SKATEBOARD
A single platform which is mounted on wheels, having no mechanism or other device with which to steer or control the direction of movement thereof while being used, operated or ridden.

No person shall use or ride upon any skateboard, roller blades, Segway® or hoverboard in any public park or public parking lot or street or sidewalk within the Village of Yorkville.

A. 
No portable sports apparatus, hoop, pole, backboard, net or other attachments may be placed in or on any public roadway, or encroach upon any Village of Yorkville right-of-way or thoroughfare. In no event shall any such apparatus, hoop, pole, backboard, net or other attachment be placed within 10 feet of any Village Street or property.
B. 
Any such sports apparatus found to be in violation of this restriction may be removed by Village of Yorkville personnel, upon 10 days' written notice to the property owner.
C. 
In the event that the Village of Yorkville Police Department shall determine that a public hazard and a threat to public safety and motor vehicle traffic exists, the sports apparatus may be removed immediately.
Any police officer or peace officer who shall observe any person using, operating or riding upon a skateboard or roller blades in violation of this chapter shall take possession of the skateboard or roller blades and issue a dated, written notice of such violation to the person, if over 18 years of age, and to the person and his or her parent or guardian, if under 18 years of age, together with a copy of this chapter at the Police Station. In case of the first offense, the skateboard or roller blades will be returned to the rider at the Police Station upon the appearance of the rider, if the rider is of the age of 18 years or older, or the appearance thereof of the rider accompanied by his or her parent or guardian, if the rider is under the age of 18 years. In the case of a second offense, the skateboard or roller blades shall be taken from the rider and not returned to him or her for 15 days upon appearance at the Village Police Station aforesaid. In the case of a third offense, the skateboard or roller blades shall be taken from the rider and not returned to him or her for 60 days, upon appearance at the Village of Yorkville Police Station as set forth above; and in the case of any further events, the skateboard or roller blades shall be taken from the rider, forfeited to the Village of Yorkville and destroyed.
