The Council of the Borough of Jersey Shore finds that there is a growing need in our community for a comprehensive Swimming Pool Advisory Board. Council further finds that the Jersey Shore Area Swimming Pool Association and Jersey Shore Recreation Board are interested in promoting, both financially and otherwise, swimming programs in the municipality. Accordingly, Council adopts the following provisions.
A Jersey Shore Borough Swimming Pool Advisory Board is hereby created to be composed and organized and to have the powers and duties as set forth herein.
A. 
The Swimming Pool Advisory Board shall be composed of seven members. Five members shall be appointed by Jersey Shore Borough. Of those five members appointed by Jersey Shore Borough, three must be residents of Jersey Shore Borough. One member shall be appointed by the Jersey Shore Recreation Board from its member. One member shall be appointed by the Jersey Shore Swim Team Parents Association from its members.

B. 
The members initially appointed by the Swimming Pool Association shall serve terms of four, three and two years and shall be and remain members of the Swimming Pool Association during their term and shall not be members of other bodies having appointee powers. The members initially appointed by Council shall serve terms of four and three years, respectively. One may be a member of Council and one may be from the citizenry of the Borough but shall not be members of the other bodies having appointee powers. The member initially appointed by the Recreation Board shall serve a term of two years and shall be and remain a member of the Board during the term. The member initially appointed by the Jersey Shore Swim Team Parents Association shall serve a term of four years. Under termination of the original terms, members shall be appointed or reappointed by the respective body, as appropriate, for four-year terms. In the event that vacancies should occur prior to the normal termination of the Board member's term, the body which had initially appointed that member shall appoint another individual to fill the unexpired term. All members shall serve without pay.
The Swimming Pool Advisory Board shall meet within 20 days of the effective date of this chapter; notice of the organizational meeting shall be given to all of the newly appointed members by the Borough Manager. At the organizational meeting, the Board shall choose a Chairman, a Vice Chairman, a Secretary, a Treasurer and any other necessary officers, to serve for the remainder of that one year. Elections shall be held the first meeting of each year thereafter, on a date to be specified by the Board in its rules and regulations.
In addition to such other powers as may be given to the Board by Borough Council from time to time, the Board shall have the following powers:
A. 
To adopt all rules and regulations governing the operation of the Jersey Shore Outdoor Swimming Pool.
B. 
To adopt qualifications and duties of all personnel employed at the pool and see that the director hires accordingly.
C. 
To hire the director of the Jersey Shore Outdoor Swimming Pool and set the duties of same.
D. 
Set opening and closing time of the pool (daily and yearly).
E. 
All complaints pertaining to the pool shall be handled by the Director and any appeals should be handled by the Advisory Board in accordance with the rules and regulations set by them.
A. 
Prepare the annual budget for the operation of the pool with the Borough Manager and submit same to the Borough Council before November 15th of each and every year.
B. 
To have at least one member meet with the Director and Borough Manager every two weeks to insure the budget is being adhered to.
C. 
To recommend to Council a plan for the continued operation of the pool including personnel, repairs, etc.
D. 
To explore all possible avenues of financial assistance.
E. 
Prepare a financial statement at the end of each pool season. This statement shall be submitted by October 15th of each and every year.
All receipts from the yearly operation of the swimming pool and all donations towards the yearly operations shall be placed in a special Borough account designated the Jersey Shore Borough Swimming Pool Account. All expenses for the yearly operation of the swimming pool shall be paid from this account.
A. 
A special account, designated the Jersey Shore Borough Swimming Pool Reserve Account, shall be established and all donations for future repairs and all funds remaining in the Swimming Pool Account in excess of $1,000 on December 31st shall be placed in this fund.
B. 
Only those expenses declared extraordinary by the majority vote of both the Jersey Shore Borough Council and the Jersey Shore Swimming Pool Advisory Board shall be paid from this account. Funds may be borrowed from this account for the opening expenses of the pool yearly, but shall be repaid by June 30th of the year the funds were borrowed.
C. 
No funds shall be withdrawn without prior written approval of both the Jersey Shore Borough Council and the Jersey Shore Swimming Pool Advisory Board.

This chapter, or any section thereof, may be amended, by resolution, from time to time, at the discretion of Jersey Shore Borough.
