It shall hereafter be unlawful for any person under 17 years of age to be or to remain in or upon any street, alley, sidewalk, park, playground, public building, public place, or vacant lot, of the Borough of Jersey Shore, after the hour of 11:00 p.m. and before the hour of 5:00 a.m., unless such person is accompanied by and in the physical presence and control of his or her parent, guardian or other person having the legal custody of such person.
It shall hereafter be unlawful for any parent, guardian, or other person having legal care or custody of a person under age of 17 years to allow or to permit any such person under the age of 17 years to be or to remain in or upon any street, alley, sidewalk, park, playground, public building, public place, or vacant lot, of the Borough of Jersey Shore, after the hour of 11:00 p.m. and before the hour of 5:00 a.m., except while such person is accompanied by and in the physical presence and control of his or her parent, guardian or other person having the legal custody of such person.
Notwithstanding the provisions of §§  146-1 and 146-2 of this chapter, it shall be lawful for a person under the age of 17 years to be or to remain in or upon any street, alley, sidewalk, park, playground, public building, public place, or vacant lot, of the Borough of Jersey Shore, after the hour of 11:00 p.m. and before the hour of 5:00 a.m., provided that such person is at such time engaged in the performance of an errand at the request of his or her parent, guardian or other person having the legal custody of such person, and provided further that such person is at such time in possession of a written statement, dated that day or the prior day, and signed by such parent, guardian or other person having the legal custody of such person, which specifies the date, time, place, purpose and necessity of the errand upon which such person is engaged.
Any person who shall violate any provision of this chapter shall be guilty of an offense and shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs, and in default of payment of such fine and costs, may be sentenced to a term of imprisonment not to exceed 30 days.
