This article shall be known as the "Regional
537 Planning Joint Agreement Ordinance" authorizing regional 537 planning.
A.
Lancaster Township, recognizing the need to undertake
537 planning and being a member municipality of the Lancaster Area
Sewer Authority ("LASA") and recognizing the benefits of having LASA
and its member municipalities undertake regional 537 planning for
the benefit of all member municipalities of LASA, has determined that
it is in the best interest of this municipality to enter into a joint
agreement with LASA and the other member municipalities of LASA for
the purposes of undertaking regional 537 planning.
B.
In adopting this article, it is the intent of this
municipality to comply with the provisions of Chapter 23 of the General
Local Government Code dealing with intergovernmental cooperation,
53 Pa.C.S.A. § 2301 et seq.
The agreement to be entered into by this municipality
is known as the "Joint Agreement Regarding Regional 537 Planning"
(hereinafter referred to as the "joint agreement").
The names of the participating municipalities
in the joint agreement are East Hempfield Township, West Hempfield
Township, Manor Township, Lancaster Township, Manheim Township, East
Petersburg Borough and Mountville Borough. In addition, Lancaster
Area Sewer Authority is a party to the Joint Agreement Regarding Regional
537 Planning. The participating municipalities and LASA are collectively
referred to herein as the "participating parties."
The purpose of the joint agreement is to enter
into a written commitment with the other participating parties to
participate in a regional 537 planning project, to authorize appointment
of a consultant for the regional 537 planning project, to set forth
an agreement as to the sharing of costs for the regional 537 planning
project among the participating municipalities and LASA to set forth
the duties and obligations of the participating parties with respect
to the regional 537 planning project.
The following officers or any two of them are
hereby authorized and directed to sign the Joint Agreement Regarding
Regional 537 Planning on behalf of this municipality: Chair, Vice
Chair, Treasurer, Secretary.
The Joint Agreement Regarding Regional 537 Planning
is attached hereto and is made a part of this article. The appointment
of the consultant named in the joint agreement to serve as consultant
for the regional 537 planning project is hereby approved.[1]
