As used in this chapter, the following terms shall have the meanings indicated:
DUMP
Any lot or piece of land within the Township of Lancaster, County of Lancaster and Commonwealth of Pennsylvania, which is open to the public or used by the public for the deposit of ashes, refuse, trash, rubbish or other waste matter, whether said land is used permissively, adversely, gratuitously, for pay or otherwise.
The Supervisors of Lancaster Township shall have supervision and control over all dumps within Lancaster Township, and said Supervisors may at any time, in their discretion, for proper cause, declare any dump in Lancaster Township a public nuisance by reason of offensive smoke, noise, odors, dust, fumes, gases or otherwise.
It shall be unlawful for any person to begin the operation of any dump, as herein defined, in Lancaster Township, without first applying for and obtaining a permit from the Supervisors of the township. The application for such permit shall describe the premises to be used as a dump and shall set forth the proposed method of operation thereof. The charge for such permit shall be $10. Such permit may be revoked by said Supervisors at any time, for proper cause. Any person who shall be operating a dump in Lancaster Township at the effective date of this chapter shall apply for such permit within 30 days after the effective date of this chapter, and shall not continue to operate the dump at the expiration of such thirty-day period unless a permit for the operation thereof shall have been granted by the Supervisors.
It shall be unlawful for any person, whether as owner, lessee, occupant or licensee or in any other capacity, to deposit or permit to be deposited on any dump within Lancaster Township, as herein defined, any putrescible, fermentable or disease- or vermin-breeding matter of any kind whatsoever.
It shall be unlawful for any person to operate any dump except with the bona fide intention of permanently filling the land used therefor. It shall be unlawful for any operator of a dump to process any waste material by burning off the burnable portion thereof and removing the remaining or unburned portion thereof, other than metal, from the dump.
It shall be unlawful for any person to kindle or maintain or permit to be kindled and maintained any fire on any dump within Lancaster Township.
Any person operating a dump in Lancaster Township shall furnish one or more custodians, who shall be present at all times on such dump, during any hours when dumping shall be allowed, and who shall be directed by the operator thereof to comply with the terms of this chapter.
No dumping shall be permitted on any dump in Lancaster Township on Sundays or legal holidays or between the hours of 5:00 p.m. and 7:00 a.m., prevailing time, on any other day.
It shall be unlawful for any person to deposit any material of any sort upon any dump in Lancaster Township, except during the times permitted in the foregoing section hereof.
Any person or any officer of any firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof before a District Justice of Lancaster County, be sentenced to pay a fine not exceeding $100, together with costs of prosecution, for each offense and, in default of the payment thereof, to be imprisoned in the Lancaster County Jail for a period not exceeding 30 days. Each day of illegal operation of such dump shall be a separate offense hereunder.
