No establishment providing services or goods
to the general public may operate for business between the hours of
12:00 midnight and 6:00 a.m. without a license for all-night operations
issued by the Board of Selectmen. Any establishment which operates
pursuant to a Common Victualler’s License or a License issued
pursuant to G.L. c. 138 shall not be required to obtain a license
hereunder.
Application, public hearing and certified mail
notification of abutters is required at the requester's expense. The
licensing authority will issue such a license only upon a showing
by the applicant that there will be no substantial impact on surrounding
areas by reason of traffic, lighting or noise resulting from operation
of the establishment between 12:00 midnight and 6:00 a.m.
An annual license fee to be determined by the
Board of Selectmen is to be payable by December 31 of each year.
Violators of this Article are subject to a fine
of one hundred dollars ($100.) per violation, with each day considered
to be a new violation.
