The existing Police Department is hereby recognized
and reestablished in and for the Borough of Milton. The Chief of Police
shall be the administrator of the Police Department. He shall, under
the direction of the Mayor, be in charge of the police force and have
the responsibility and authority for the proper administration, supervision
and discipline of the Department and its members. The Chief of Police
shall have the authority to establish rules and regulations for the
Department to ensure the proper administration, supervision and discipline
of the Department, provided that such rules and regulations do not
conflict with the contract between the Borough and the Milton Police
Officers' Association and the Pennsylvania Borough Code.[1]

B.
The priority of authority among such subordinate classifications
shall be in the order above listed. The duties of each classification
shall be as established by the Chief of Police. The time for filling
these subordinate classifications, the persons to serve in each classification
on a full-time or part-time basis and the compensation of each shall
be as determined solely by the Borough Council with the recommendation
of the Chief of Police.

C.
The compensation to be paid to each officer selected
to fill the position of Lieutenant, Sergeant and Corporal shall be
as agreed upon by the Borough Council and the officer filling that
respective classification.

Nothing herein contained shall affect the authority
of the Mayor to appoint special policemen.

The Borough of Milton is hereby authorized and
directed to enter into a mutual aid and assistance agreement with
the following parties: the City of Sunbury, the Borough of Lewisburg,
the Borough of Northumberland, the Borough of Riverside, the Borough
of Watsontown, the Township of Point and the Township of Ralpho, all
of the County of Northumberland, Pennsylvania; the Borough of Middleburg,
the Borough of Selinsgrove, the Borough of Shamokin Dam and the Office
of the Sheriff, all of the County of Snyder, Pennsylvania; and the
Borough of Mifflinburg, the Township of East Buffalo and the Office
of the Sheriff, all of the County of Union, Pennsylvania.
Upon request of any of said parties, the Police
Department of the Borough of Milton shall furnish the requesting party
actual standby aid and assistance in municipal and police emergencies
when authorized and directed to do so by the Chief of Police or, in
his absence, the Mayor, and to such an extent as shall be determined
by the Chief of Police or, in his absence, the Mayor. Compliance with
such a request shall be on a voluntary basis and shall be granted
only when adequate police protection is provided for within the Borough.
Any such aid and assistance furnished may be recalled at the discretion
of the Chief of Police or, in his absence, the Mayor.
Upon request of the Chief of Police or, in his
absence, the Mayor, the police of the furnishing party shall be authorized
to answer calls and to provide police protection and services in the
Borough of Milton through the use of both personnel and equipment
in the same manner and to the same extent as would the police of the
Borough of Milton.
Except for general directions or instructions
by the Chief of Police or, in his absence, the Mayor or a designated
police officer, the personnel of the furnishing party shall work as
far as possible under their own supervisors, and the equipment furnished
shall, to the extent possible, be operated by said personnel.
No charge, compensation or reimbursement shall
be paid to any furnishing party for services rendered or expenditures
made in connection with the furnishing of aid and assistance.
The Borough of Milton shall not be held liable
nor shall it hold any other party to said agreement liable for failure
or inability to furnish aid and assistance, from time to time.
All police officers of the Borough of Milton
shall, at all times, remain the employees of the Borough, and all
personnel of the furnishing party shall, at all times, remain the
employees of the furnishing party, who shall remain liable for their
wages, workmen's compensation and all other duties and responsibilities
pertaining to their employment.
The Borough of Milton shall endure as a party
to said agreement until such time as it withdraws there from upon
30 days' written notice to each of the other parties.
