§ 93-10 Definitions. [1]

As used in this article, the following terms shall have the meanings indicated:
Any animal not under the restraint of a person capable of controlling the animal on or off the premises of the owner.
When applied to the proprietorship of an animal, the term "owner" includes every person having a right of property in such animal and every person who permits such animal to remain on or about any premises occupied by him.

§ 93-11 Unlawful acts; identification tags.

It shall be unlawful for any person or persons to permit any animal owned, kept, maintained or in the custody or control of such person or persons to be repeatedly found at large, to damage the property of anyone other than its owner, to molest or intimidate pedestrians or passersby or to be vicious, i.e., to attack, bite or injure human beings or other animals without adequate provocation. All dogs and cats must wear identification tags at all times when off the premises of their owners.
Identification tags must state the animal owner's name and address. Dogs with valid Pennsylvania dog licenses need not have an additional identification tag.

§ 93-12 Violations and penalties.

Except as may otherwise be provided in 3 P.S. § 459-101 et seq., any person or persons violating or failing or refusing to comply with any of the provisions of this article shall, upon conviction in a summary proceeding before a District Justice, be sentenced to pay a fine of not more than $600, of such fine and costs, imprisonment for a term not exceeding 30 days.

§ 93-13 Use of fines and charges.

The fines assessed and charges imposed hereunder shall be for the use of the Borough of Milton.

§ 93-14 Position of Animal Officer established.

There is hereby established the office of Animal Officer of the Borough of Milton, whose duties shall consist of enforcing the provisions of the within Article.

§ 93-15 Employment of Animal Officer authorized.

The Borough Council of the Borough of Milton is hereby authorized and empowered to employ an Animal Officer as provided in § 93-14 hereof to carry out the provisions of this article, upon such terms and conditions of compensation as may be approved by the Milton Borough Council from time to time.
