No owner and/or person having possession, custody or control of a cat, dog or domesticated or nondomesticated animal shall allow said cat, dog or domesticated or nondomesticated animal to defecate, defile or befoul upon any gutter, street, driveway, alley, curb or sidewalk in the Borough or upon floors or stairways of any building or place frequented by the public or used in common by the tenants or upon the outside walls, walkways, driveways, alleys, curbs or stairways of any building abutting on the public street or park or upon the grounds of any public park, public areas or upon private property other than the property of the owner.
Any owner or person having possession, custody or control of a cat, dog or animal, domesticated or nondomesticated, as prohibited in Subsection A hereof, other than on the private property of the owner, shall be required to immediately remove the feces from such surfaces and carry the same away for deposit in a toilet or in any other sanitary manner.
The provisions of this article shall not apply to a guide dog accompanying any blind persons or to a dog used to assist any other physically handicapped persons of to animals used in police or fire activities of the Borough or to animals participating in a parade authorized by the Borough.
No owner shall allow defecation to accumulate on his property to the point where it becomes a health hazard and/or a public nuisance.
The provisions of this article shall be enforceable by the Animal Officer of the Borough of Milton and the Police Department of the Borough of Milton.
