The making of unnecessary, unusual noise or any noise which either annoys,
disturbs, injures or endangers the comfort, repose, health, peace or safety
of others within the limits of the borough is declared to be a public nuisance.
Enumeration of the particular offenses hereinafter particularly defined shall
not be construed as limiting the generality of the section or limiting the
offenses hereunder to particular offenses hereinafter enumerated.
It shall be unlawful for any person operating any vehicle in the Borough
of Milton to cause the tires of his vehicle to squeal and thereby cause noise
and disturbance to the peace of the community, and the same is hereby declared
to be a nuisance.
It shall be unlawful for any person to use, operate or permit to be
played, used or operated any radio receiving set, musical instrument, phonograph
or other machine or device for the producing or reproducing of sound in such
manner as to disturb the peace, quiet and comfort of the neighboring inhabitants
or the public at any time with louder volume than is necessary for convenient
hearing for persons who are in the room, vehicle or chamber in which such
machine or device is operated and who are voluntary listeners thereto, and
such activity is hereby declared to be a nuisance.
Permits which shall be limited in time by the issuing officer may be issued in accordance with § 161-5 of this chapter to any persons, organizations or corporations for any of the following purposes:
A.
The use of loudspeakers, the playing of bands or orchestras
or the making of other unusual or loud noises or sounds at festivals, block
parties or other gatherings which are held by any group for the betterment
of the borough or for any charitable or philanthropic group or cause.
B.
Noises in connection with demolition, alteration and
repair to any building, which permit must be for times between the hours of
7:00 a.m. and 6:00 p.m. on weekdays, excepting in cases of urgent necessity
in the interest of public health and safety, and then only with a permit from
the Borough Manager, which permit shall not exceed in term a period of three
days or less while the emergency continues.
C.
The use of loudspeakers on sound trucks or other platforms
for political advertising purposes.
Whenever any person, organization or corporation obtains a permit for the fee of $25 per day in accordance with § 161-4 from the Borough Manager, that person, organization or corporation, during the term of the permit, shall be exempt from the operation of this chapter, provided that such permit is clearly displayed or is available during the permitted activity.
Any person violating the provisions of this chapter shall be guilty
of a summary offense and shall be fined not more than $1,000, plus costs of
prosecution, and, in default of payment of such fine and costs, shall be imprisoned
for a period not exceeding 30 days.
