As used in this article, the following terms shall have the meanings indicated:
IMPROVED SURFACE
The area between the curbs of a public street or alley, and if no curbs are installed, then the area which is paved or on which vehicles normally travel or are parked.
PERSONAL PROPERTY
Shall include, but shall not be limited to, athletic equipment, trailers, campers, storage or refuse containers, bicycles, toys, furniture and any other type of personal property not approved by the Borough of Milton.

A. 
No personal property, except for properly-licensed motor vehicles with visible proof of current registration and inspection and items excepted in § 233-68 hereof, shall be permitted to be placed, stored, or parked on the improved surface of any public street or alley, since such items pose a hazard and hindrance to motor vehicles, street cleaning, snow removal, brush and leaf removal, maintenance operations, and stormwater drainage.
B. 
Exceptions. Storage of certain personal property used in construction, demolition or maintenance purposes shall be permitted to be stored in the said public streets or alleys provided written permission is obtained from the Borough Manager prior to placement of the item there, and placement is in accordance with the Borough Manager's instructions. These shall include dumpsters, construction offices, storage trailers, construction equipment, and similar items necessary for the aforesaid purposes.
C. 
Violations and penalties.
(1) 
First violation: warning.
(2) 
Second violation: $15 fine.
(3) 
Third and each subsequent violation: $50 and/or imprisonment for a term not to exceed 30 days.
(4) 
Each day's continuance of a violation shall constitute a separate offense.
(5) 
Any such property in violation of this Article XI deemed by the Borough of Milton to create an imminent danger to persons and property, or an obstruction to the necessary operations of the Borough, may be removed by employees of the Borough of Milton, or its designated authority or agency, and the costs of such removal shall be levied against the property owner. Failure to pay removal costs may result in additional prosecution, prosecution costs, court costs, and in default of payment of said costs, imprisonment for a period of not more than 30 days.
