The Mayor or his Chief of Police may from time to time designate those municipal officers within the City of Monessen to be assigned to an Anti-Drug Task Force. Nothing in this article shall circumscribe the authority of any municipal police officer empowered by state law to arrest in accordance with the Rules of Criminal Procedure any person or persons violating the Controlled Substance, Drug Device and Cosmetic Act,[1] which authority is reserved unto that arresting officer under the Pennsylvania Crimes Code.[2]

Upon arrest and conviction of a drug related crime, the city, through its arresting officer, shall petition the sentencing Judge for permission to declare all fruits of the crime, including cash, to be the property of the Anti-Drug Task Force of the City of Monessen.
The Director of Accounts and Finances is empowered by this article to establish a specific account earmarked for the reception of cash proceeds determined by the sentencing court to be forfeited as fruits of a crime, under law.
Any such moneys received by the Anti-Drug Task Force shall first be applied to the costs of prosecution, including police testimony and overtime, and thereafter shall be utilized for purposes of further efforts to combat controlled substance activity within the City of Monessen. Said money shall be utilized from time to time upon the request of the Mayor or Chief of Police upon majority vote of Council.
Upon arrest of any person within the City of Monessen, the District Attorney, the Attorney General, the Federal Bureau of Investigation, the Drug Enforcement Agency or any other arresting officer, department or branch of any local, state or federal government shall notify said department of the claim by the Anti-Drug Task Force of the City of Monessen to any proceeds, including cash, resulting from the arrest and conviction of any person within the City of Monessen.
