It is the intention of this regulation that all matters herein which require action or decision by the City Council shall first be referred to the Planning Commission for its detailed recommendations as to the course to be followed and furthermore of the community interest and the Comprehensive Master Plan.
It shall be the duty of the City Engineer to administer the provisions of this chapter and enforce the decisions of the Planning Commission made hereunder and to report any violations thereof to the Planning Commission.
Any person, firm, partnership or corporation violating any provisions of this chapter shall, upon conviction thereof in a summary proceeding before any District Justice having jurisdiction of such offense, be sentenced to pay a fine of not more than $300 or to undergo imprisonment not exceeding 90 days, or both. Each day that any corporation, firm, partnership or person shall continue to violate or fail to comply with any requirements of this chapter shall be considered as a separate offense. All fines and penalties imposed by this chapter shall be recoverable by summary proceedings by any Alderman or Justice of the Peace in said city, and all suits or actions at law instituted for the recovery thereof shall be in the name and for the use of the city, and upon recovery thereof, all such fines and penalties shall be paid to the City Treasurer. In addition to the penalties provided herein for the violation of this chapter, the City Council may institute appropriate action or proceedings to prevent any unlawful subdivision or use of land within the City of Monessen or for a distance of three miles outside the city or to restrain, correct or abate any violation of the provisions of this chapter.
