PEDDLING
PERSON
As used in this chapter, the following terms shall have the meanings
indicated:
Any person who shall engage in peddling, as herein defined.
Engaging in peddling, canvassing, soliciting or taking of
orders either by sample or otherwise for any goods, wares or merchandise,
the solicitation for any advertising or for the sale of any service
or product whatsoever on any of the streets or sidewalks or sidewalks
or from house to house in the Township of Nockamixon, provided that
the word "peddling" shall not apply to farmers selling their own produce,
or any manufacturer or producer in the sale of bread and bakery products
and meat products or milk products.
Any natural person, association, partnership, form or corporation.

In this chapter, the singular shall include the plural and the masculine
shall include the feminine and the neuter.
No person shall engage in peddling in the Township of Nockamixon
without having first taken out a license as hereinafter provided.

Every person desiring to engage in peddling in the Township of Nockamixon
shall first make application to the Township Zoning Officer for a
license. Upon such application such person shall give his name; address;
his previous criminal record, if any; the name of the person for whom
he works, if any; the types of goods, wares, merchandise or service
he wishes to peddle; the length of time for which he wishes to be
licensed; the type of vehicle he uses, if any; and shall furnish an
untouched photograph of the face and head of the applicant two inches
by three inches in size in duplicate.

No license issued under this chapter shall be transferable from one
person to another.

No license shall be issued under this chapter until a fee in
the amount of $5 has been paid to the Township Zoning Officer for
the use of the Township.
Upon making application therefor and payment of proper fee herein
specified, a license shall be issued to every peddler. Such license
shall contain the information required to be given upon the application
therefor. Every peddler shall at all times when engaged in peddling
in the Township, carry such license upon his person, and shall exhibit
such license, upon request, to all police officers, Township officials
and citizens. No peddler shall engage in selling any product not mentioned
upon such license.
No person licensed as a peddler under this chapter shall engage
in peddling at any time on Sunday, or upon any day of the week before
9:00 a.m. or after 9:00 p.m.

The Township Zoning Officer shall keep a record of all licensees
issued under this chapter and shall supervise the activities of all
holders of such licenses.

The Township Zoning Officer is hereby authorized to suspend
any license issued under this chapter when the Township Zoning Officer
deems such suspension to be beneficial for public health, safety or
morals, or for violation under the provisions of the ordinance or
for giving false information upon any application for a license hereunder.
Any license issued under the terms of this chapter shall be
good for a term of six months from the date of issue, after which
the license issued shall expire and a new one must be issued.
Any person who violates or permits a violation of this chapter
shall, upon conviction in a summary proceeding brought before a District
Justice under the Pennsylvania Rules of Criminal Procedure, be guilty
of a summary offense and shall be punishable by a fine of not more
than $1,000, plus costs of prosecution. In default of payment thereof,
the defendant may be sentenced to imprisonment for a term not exceeding
30 days. Each day or portion thereof that such violation continues
or is permitted to continue shall constitute a separate offense, and
each section of this chapter that is violated shall also constitute
a separate offense.
