A certain document, three copies of which are on file in the office of the Secretary of the Borough of Prospect Park, being marked and designated as "The BOCA National Property Maintenance Code, Fourth Edition, 1993," as published by the Building Officials and Code Administration International, Inc., be and is hereby adopted as the Property Maintenance Code of the Borough of Prospect Park, in the Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter with the additions, insertions, deletions and changes, if any, prescribed in § 96-3 of this chapter.
All ordinances or parts of ordinances of the Borough of Prospect Park in conflict herewith are hereby repealed.
The BOCA National Property Maintenance Code is amended and revised in the following respects:
A. 
Section PM-101.1 (page 1, second line). Insert "Borough of Prospect Park."
B. 
Section PM-106.2 (page 3, third line). Insert "not less than $50 and not more than $1,000."
C. 
Section PM-106.2 (page 3, fourth line). Insert "30 days."
D. 
Section PM-304.12 (page 11, first line). Insert "from May 15 to September 15."
E. 
Section PM-602.2.1 (page 17, fifth line). Insert "September 15 to May 15."
F. 
Section PM-602.3 (page 17, fifth line). Insert "September 15 to May 15."
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 96-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.

A. 
An operating license for all rented, leased or subleased single- or multiple-family dwellings or rooming house shall be valid for a period of one year, unless revoked, and such license shall be renewable for successive periods of one year from the original date of application for said license. License shall not be transferable.
B. 
Any rented single-family dwelling owner whose tenant has five police complaints against the tenant or property will have its operating license and its use and occupancy license suspended. After three complaints, the owner will be notified, via certified mail, that there have been three complaints against his tenant or property and after an additional two complaints the operating license and/or use and occupancy license will be withdrawn for one year.
C. 
Any owner of an apartment building which has five police complaints on a single apartment unit will have its operating license revoked on that apartment. After three complaints, the owner will be notified, via certified mail, that there have been three complaints and after an additional two complaints, the operating license for that apartment unit will be withdrawn for one year.
D. 
The owner will be notified that there have been five complaints and his use and occupancy license and his operating license have been withdrawn. Once notified of the six complaints, the owner shall have seven days to start eviction proceedings and show proof and court date to the Borough. If proof is not shown in seven days, a citation shall be issued on a weekly basis until proof is shown of eviction proceedings. After tenant is evicted, the one-year suspension will commence.
