GENERAL REFERENCES
Individual sewage disposal systems — See Ch. 401.
Water systems — See Ch. 413.
Any open or unguarded well, cistern, cesspool or excavation in which water has accumulated from any source, and abandoned construction or mining excavations situated within the Township, are hereby declared to a public nuisance.
Any public nuisance shall be abated without further notice by the owner of the land on which the public nuisance exists.
As used in this chapter, the following terms shall have the meaning indicated:
ABANDONED CONSTRUCTION OR MINING EXCAVATION
One in which further construction or mining operations have been permanently discontinued.
OPEN OR UNGUARDED WELL, CISTERN or CESSPOOL
One which is not securely covered by a cover sufficient to withstand 500 pounds pressure per each 10 square feet of the cover area, or completely enclosed by a permanent fence at least four feet in height.
When any property owner violating any of the provisions of this chapter fails or refuses to abate any of the aforesaid nuisances, the Township Board of Health may, upon 10 days' written notice to such owner, cause such nuisance or nuisances to be abated and the reasonable cost of such abatement shall be chargeable against the owner of the land on which such nuisance or nuisances shall have existed.
