A body corporate and politic be and is hereby created pursuant to and in conformity with New Jersey Revised Statutes 55:14A-4, to be known as the "Housing Authority of the City of Hackensack."
Said Housing Authority of the City of Hackensack shall consist of six members as Commissioners of the Authority. Five of said members shall be appointed by the Hackensack City Council and be designated to serve for terms of one, two, three, four and five years, respectively, from the date of their appointment, but thereafter Commissioners so appointed shall hold office for a term of five years, except that all vacancies shall be filled for the unexpired term. The sixth member of said Authority shall be appointed by the Director of the State Housing Authority as provided by statute.
Not more than one Commissioner of the Authority may be an officer or employee of the City, and all Commissioners shall hold office until their successors have been appointed and have qualified. A certificate of appointment or reappointment of any Commissioner shall be filed with the City Clerk and such certificate shall be conclusive evidence of the due and proper appointment of such Commissioner.
Four members shall constitute a quorum of the Authority for the purpose of conducting its business and exercising its powers and for all other purposes. Action may be taken by the Authority upon a vote of the majority of the Commissioners present, unless in any case the bylaws of the Authority shall require a larger number.
The Authority shall select a Chairman and Vice-Chairman from among its Commissioners and it may employ a secretary (who shall be executive director), technical experts and such other officers, agents and employees, permanent and temporary, as it may require, and shall determine their qualifications, duties and compensation. For such legal services as it may require, the Authority may call upon any chief law officers of the city, or may employ its own counsel and legal staff.
The Commissioners of such Housing Authority shall exercise all the power and authority granted by and be subject to all the provisions of Chapter 14A of Title 55 of the Revised Statutes now or hereafter enacted applicable to said housing authorities.
The Clerk is hereby authorized and directed to file a certified copy of this chapter with the executive office of the State Housing Authority.
