The Mayor of the city shall be the chief executive
officer thereof, whose term shall be four years. He shall appoint
the appointive officers hereinbefore specified; maintain the peace,
good order and prosperity of the city; take care that within said
city the laws of the state and the ordinances of the Common Council
and the Board of Health are enforced; take such action as is authorized
by law, whenever necessary, for the prevention or suppression of public
disturbances, mobs or riots; exercise a constant supervision over
the conduct of all subordinate officers; receive and examine into
all complaints against such officers for misconduct or neglect of
duty and suspend them, and prefer charges against officers so offending
to the Common Council; and shall have all of the powers and duties
of a Mayor, as authorized by State or local law, and shall have all
the powers and duties set forth in §§ C4-2 and C4-3
of this Charter of the City of Kingston and any other powers to be
designated to the Mayor. He shall devote substantially all of his
time to the duties of the office.
All bills, orders, resolutions or ordinances
which pass the Common Council, for the expenditure of money or of
a legislative or other character, shall be presented to him for approval
or disapproval. If he approves, he shall endorse his approval thereupon,
in writing, and sign such approval; if he disapproves, he shall return
such transcript to the Common Council or Clerk thereof, with his objections,
in writing, which shall be filed by the Clerk, and the Common Council
shall, at its next regular meeting thereafter, proceed to reconsider
the ordinance, resolution, orders or acts thus disapproved, and if
the same shall be passed by 2/3 of the members of the Common Council
then in office, the same shall have full force and effect notwithstanding
the objections of the Mayor. If any such transcript is not returned
by the Mayor to the Common Council, or Clerk, within five days after
it has been presented to him (Sunday excepted), such ordinance, resolution,
order or act shall have full force and effect in like manner as if
duly approved by the Mayor, unless the term of office of Mayor expires
within five days after such transcript has been presented to him,
in which case such ordinance, resolution, order or act shall have
no force.
The Mayor may at any time examine the books,
vouchers and papers of any board, department, commission, officer
or employee of the city insofar as they relate to city matters, and
summon and examine under oath any person or persons in relation thereto.
The Mayor shall prepare and present during the
first month of each fiscal year of the City an annual message to the
Common Council. The annual message shall describe the condition and
state of the city and shall identify matters and issues the Mayor
believes should be addressed by the Council in the ensuing year.
In case of the absence or inability of both
the Mayor and the Alderman-at-Large, the Common Council shall temporarily
appoint one of their number to perform the duties of Mayor; but said
person shall not have the power to remove appointive officers.
