There shall be a Department of Public Works, the head of which shall be the Director of Public Works, who shall be the Town Administrator or a person appointed by him/her. Further organization of the department into divisions or offices shall be made by the Town Council by ordinance, on recommendation of the Town Administrator; provided, however, that the office of Town Engineer, if any there be, is included in the organization of the Department.

The Director of Public Works if he/she be other than the Administrator shall have had at least five years' experience in municipal administration and a postsecondary degree.

The Department of Public Works shall be responsible for the functions and services of the Town relating to streets, highways, sidewalks, bridges, watercourses, street lighting and storm sewers; for the collection and disposal of garbage and other refuse; for the construction, maintenance, repair and operation of all public buildings and properties other than those of the School Department and the Water Commission, belonging to or used by the Town; for building, electrical and plumbing inspection, and the issuance of building, electrical and plumbing permits; for regulation of weights and measures; and for such other functions as may be prescribed by ordinance, whether they be performed by this department or by others under contract. The Department of Public Works, under the direction of the Town Administrator, shall cooperate with other branches of the Town government by furnishing labor, materials and equipment, provided that the costs of such cooperative efforts are reimbursed by the agencies thus served.

The Director of Public Works shall be, or he/she shall appoint or designate, the Tree Warden; and he/she shall be, or he/she shall appoint or designate, the Building Official, and he/she shall appoint or designate the assistants of the Building Official, including the Plumbing and Electrical Inspectors; and he/she shall be, or he/she shall appoint or designate, the Fence Viewer.
