GENERAL REFERENCES
Fire prevention — See Ch. 152.
There is hereby established a part paid and volunteer Fire Department in and for the City of Linwood to be known as the Linwood Volunteer Fire Company No. 1.

Said volunteer fire company shall consist of a Chief, Deputy Chief and Assistant Chief who shall be volunteers; two Captains, one of whom shall be a paid man; and such other officers as may be required under the constitution and bylaws of the volunteer company.
A. 
It shall be the duty of the Chief of the part paid and volunteer Fire Department to make or cause to be made such inspections as may be requested or required by other official municipal departments or by law of the state or municipality adopted heretofore or hereafter.
B. 
It shall be the duty of the Chief to call out whenever he deems necessary, any and all companies for practice drills and training. Said drills and training to be so conducted as to insure the proper and efficient use of all appliances and apparatus.
C. 
It shall be the duty of the Chief and his assistants to take full command at all times in which the department is in service. In event of a fire, the Fire Chief shall have authority over all municipal departments and personnel. In event of other emergencies where the cooperation of the Fire Department is requested, the Fire Chief shall cooperate with and assist the Chief of the municipal service in command. The Fire Department in no instance shall be called upon as a department to assist in the suppression of any riot or civil disturbance.
D. 
The Chief shall have no power to suspend or discharge any member of the paid Fire Department, but he may prefer charges against any member. Said charges must be in writing, directed to the Chairman of the Fire Committee of the City Council, who in turn may reprimand, fine or suspend such member. The volunteers shall be governed by the constitution and bylaws of the volunteer fire company.
E. 
The Deputy Chief or Assistant Chief shall act in the absence of the Chief and shall have the same authority as the Chief. He or she shall perform such other duties as prescribed in the constitution and bylaws of the volunteer fire company.

F. 
It shall be the duty of the paid Fire Captain to see to the care and maintenance of the apparatus and equipment. It shall also be his duty to keep records of all alarms of fires, fire losses and methods of extinguishment, drills, equipment inventories, apparatus and equipment tests. A regular yearly report of the above mentioned shall be forwarded to the Chairman of the Fire Committee of the City Council by the paid Captain as soon after the close of the calendar year as possible.
A. 
Membership in the fire company shall consist of a minimum of three paid men in addition to the paid Captain. The number of volunteers will be according to the constitution and bylaws of the volunteer company.
B. 
No person shall hereafter become a paid member of the Fire Department of the City of Linwood unless he is a citizen of the United States. He shall be between the ages of 18 and 40 years unless he is a veteran of World War II or the Korean Conflict, who entered the active service of the Armed Forces after July 1, 1940, and prior to April 24, 1945, or after January 1, 1950, and prior to December 31, 1955. The maximum age limit is 40 years. In determining maximum age eligibility of all veterans applying for appointment, the time spent in active service in the time of war shall be deducted from the attained age. The age of volunteer members shall be in accordance with the constitution and bylaws of the volunteer company.

C. 
Successful candidates for appointment to the paid department of the City of Linwood shall, upon receiving such appointment as a paid fireman, be sworn in by the City Clerk, receiving a badge to be worn at all times while on duty, said badge to be returned to the Fire Department upon dismissal of any member.
Candidates for the position of full-time paid firemen or volunteer firemen shall submit to a thorough medical and physical examination, evidenced by a certificate by the examining physician that he or they are physically and mentally fit to perform the duties of a fireman and that they suffer from no respiratory diseases.
Salaries for the paid firemen shall be in accordance with the published salary ordinance.[1]

The hours and duties of the paid firemen shall be determined by the Chairman of the Fire Committee of the City Council and shall be administered by the paid Captain.
