The Town Board of the Town of Colonie hereby:
A. 
Accepts the applicability of the State Fire Prevention Code for the Town of Colonie to become effective in said Town of Colonie on the first day of July 1977, in accordance with the provisions of § 392 of the Executive Law; and
B. 
Adopts, for purposes of prescribing codes and standards to be used to implement the Fire Prevention Code of the State of New York, those codes and standards adopted by the National Fire Protection Association and compiled and known as the "National Fire Codes." It is the intent of the Town Board of the Town of Colonie that the National Fire Codes applicable at any one time shall be those last promulgated by the National Fire Protection Association and in effect as of the date the need for applicability arises.

The Town Clerk is hereby instructed to file a certified copy of this chapter in the principal office of the State Building Code Council, Division of Housing and Community Renewal, at Two World Trade Center, New York, New York 10047.
Any person who shall violate any of the provisions of this chapter shall be guilty of an offense, punishable by a fine of not more than $250 or by imprisonment for not more than 15 days.

A. 
A Board of Review is hereby established for the purpose of granting variances where enforcement of any provision or requirement of the State Fire Prevention Code results in practical difficulties or unnecessary hardships. Any such variance shall be consistent with the spirit of the code and shall not be inconsistent with Subdivision 2 of § 391 of the Executive Law.
B. 
The Board of Review shall be composed of existing Zoning Board of Appeals, and the terms of such members shall be identical with the terms of the Zoning Board of Appeals.
C. 
The Board of Review may adopt regulations governing its procedures and appropriate forms for efficient administration.
D. 
The Town Clerk and the Department of Fire Prevention[2] shall obtain a copy of the Board of Review's decision for their records.
