No individual, association, organization, business, governmental entity, or other group shall hold or cause to be held a fireworks display, either aerial or ground, without first obtaining a permit from the City Council.
Any party wishing to hold a fireworks display shall apply for a permit for said display by filing an application with the City Clerk at least 30 days prior to the date on which the display is to be held. The Clerk shall forward said application to the City Council for action at its next scheduled meeting. The Clerk shall inform the applicant of the date of the meeting at which the application will be considered.
The City Council may grant the permit subject to reasonable restrictions as to time, length of display, and disruption of the neighborhood in which the display is to take place.
No permit granted under this chapter shall be valid until the applicant has also applied for and received a permit for a fireworks display from the Northampton Fire Department in accordance with 527 CMR, Section 2.04. The permit granted by the City Council under this chapter shall not authorize any fireworks display unless said permit from the Fire Department has been granted.
The party receiving a permit for a fireworks display shall cause notice of said display to be published in a newspaper of general circulation in the City at least one week in advance of the date of said display. Notice of said display shall also be given on a radio station serving the City at least once during the week preceding the date of the display. Any notice hereunder shall include the date, time, place, and sponsor of the display.
