No person shall operate or drive a boat upon any waters or waterways within the Town of Amherst at a rate of speed in excess of five miles per hour.
This chapter shall not apply to waters or waterways within the corporate limits of the Village of Williamsville or to such waters or waterways with respect to which the regulation of speed may be regulated or prohibited by the laws of the United States and the State of New York.
The term "boat" shall include every vessel propelled in any manner other than by hand.

Every violation by any person, firm, association or corporation of any of the provisions of this chapter shall be deemed to be an offense against this chapter, and upon conviction therefor, such person, firm, association or corporation shall be subject for the first offense to a fine not exceeding $10, and for a second or subsequent offense by a fine not less than $10 nor more than $25, or to imprisonment for not less than two days nor more than 15 days.
